Start CR-1 or try VWP+AOS?

In addition to the issue of intent, AOS through VWP is not practical because you are just visiting in November and your plans of moving to the US seem to be for 2022. Once you AOS, you cannot leave the US for a pretty long time, at least 5 months. That's without considering the time it takes to fill out the AOS paperwork and put together all the evidence... it would be incredibly suspicious to have the paperwork ready once you get to the US file as well.

You can file a spousal visa right now and she can still travel to the US while that is being processed. But file ASAP. Also, if you've been married for more than 2 years by the time you get the visa, she'll get a 10 year green card.

Going to try to respond to multiple people at once, hope it's not too messy.
Thanks Coco8 for your response. I think the travel info I mentioned might not be actually relevant here. In any case, you bring up an interesting point. I've been married now for just over a year which means I would file the CR-1, but by the time it's complete/(processed?), we might have already married for two years. Does that mean she wouldn't get a 10 year green card? Gonna rope @HRQX and @Jorgedig into the mix here.

@Chocobo Thanks for sharing your experience. Hope all goes well for you.

@crazycat Great to see a fellow USC in Taiwan! Are you trying to get your wife US citizenship as well? Or do you plan to stay here indefinitely?

@Israth Are you in the US while your wife is back home?

The US entry date in relation with the 2-year marriage anniversary is what matters.

We moved to the US.  My wife has been here in the US since 2017.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Got it. How long does the process take to receive a CR-1? Is it dependent on the country of origin? Thanks!

@crazycat Ah, my bad. Read your message wrong. Congrats on returning to the states! I bet you're missing the food here.

I'm in Bangladesh, husband in USA.

USCIS 4-10 months

NVC 2-4 months

Interview wait time, depending on county backlog, i.e Pakistan 1 year after NVC completion, Bangladesh few months after NVC completion

Best of luck!

Having to separate is fairly common as far as I’m aware. Especially since spouses are usually also the sponsor, the USC needs to proof domicile in the US. I was separated from my wife for 8 months, but that was in part because she went back to the States to help her parent.
