Cousin Marriage on CR-1... Moving to Texas

ASKING THIS FOR MY FRIEND. 

 

Hello! I have questions regarding my cousin marriage. I have married to my wife in my home country, who is my cousin and as well as her visa(cr1) is over here and she is all set to leave.

1. Our original residency is in New jersey but we are trying to move to texas because NJ is really expensive for us. Can we live in texas after departing from our home country? Will there be a problem on point of entry on Texas? As we haven't went to NJ yet. Or should we live in NJ till my wife's gc is here. 

2. Everything is well and now we have started to live Texas. Now, will there be a problem regarding Social Security card? Do we have to go to NJ for her Social security card or can we proceed to the local office of SS card in Texas. (The residency address will be same and won't be changed as it is my uncle's house and that is where we intended to live in NJ)

1. Is the fact this is a "cousin marriage" relevant to the questions? Meaning, does your friend have concerns about their familial connection or is that irrelevant to the questions?

2. Do they already have somewhere they can live in Texas? They can live where ever they want in the U.S. but I'm not sure of the logistics of arriving and starting a life in a state where they'd still have to sort out where to live, work, bank, etc. 

3. If they do change their U.S. address, they have to update that so the green card is delivered. I don't think it's a good idea to keep using the uncle's address if it's not where they actually reside. 

4. What do they mean by "everything is well and now we have started to live in Texas"? Is this hypothetical?

5. They can apply for SSN from whatever social security office is close by. It doesn't matter.

You can marry you cousin in Alaska  Arkansas  California  and more.it’s not prohibited in all Muslim countries .

Moving to Texas will depend.  IS this a first cousin, second cousin or third cousin marriage because in Texas it does matter.

Adding to my comment above. It will not matter in Texas if the state you married in says it's a legal marriage. In Texas the marriage will be voided and charges can be filed.  Consulates are well aware of Texas laws makin it illegal. You can't marry somewhere else and move to Texas. If at the interview they knew that this couple would want to move to Texas they would deny the visa unless they could prove where they would be living in a state where it would be legal. 

 

My advice if you are first cousins get out of Texas now. Your marriage will be void there and they can and have charged ppl.

She can purchase a flight ticket to any state she wants as soon as she got her passport stamped. Producing a GC will take a little time .use it to call uscis to change the Andres or do it online .as living with your married cousin in Texas . No problem at all if your a Muslim..

Incorrect.   Relocating to a state that prohibits cousin marriage will lead to legal problems later on with ROC.

USCIS/DOS will not approve petitions or visas for first cousin marriages if the intended residential state prohibits it by law.   I don’t recommend anyone try to circumvent this.

Change her address at POE for delivery so that the card is mailed to Texas (I think they ask for address verification at POE).

Go to Texas DMV. You shouldn't have any problems.

 

 

It is legal is some cultures/ countries.

This is not true if you are married to a first cousin.

Never knew it would be a problem "post marriage."

I thought what mattered was where they got married. And from OP, it seems they are already married and even got the CR-1 Visa, just waiting to come to US.

States like Texas has it outright illegal.  The marriage is void in places like Texas and they do charge ppl. The last thing this couple wants is to be placed on the sex offenders registry.

The ROC would be based on a marriage that would not be recognized as legal, so they would not be allowed to remove conditions.
