Good afternoon.  I ask for advice.  This is the situation.  In January of this year, my husband filed 130i petition for me and my two children.  in March, a letter was received to provide additional information.  The immigration agency my husband contacted did not send a passport size photo.  and in the end, the children's petitions were approved, and my petition was rejected.  in June, the immigration agency filed an appeal.  but as it turned out to the wrong address.  the appeal was returned.  the agency manager resubmits the appeal, but to a different address, and there is no information.  Where can I find out the correct address for filing an appeal?  and how can you find out the result of the acceptance of the appeal?  if someone had a situation with an appeal, please write.

Do you know why the immigration agency is looking to submit an appeal? I am Not sure if an appeal will work in this case. The petition was not rejected due to a USCIS error but rather due to all documentation not submitted as requested. You may need to reapply unless it is the fault of USCIS.

После того, как моя петиция была отклонена, из USCIS пришло письмо, в котором говорилось, что я могу подать апелляцию. Мы так и сделали. но апелляция была возвращена, потому что апелляция была отправлена не по адресу. Что мы можем сделать ?

After my petition was rejected, a letter came from USCIS saying that I could appeal.  We did just that.  but the appeal was returned because the appeal was sent to the wrong address.  What we can do ?

Unless you are in the Russia/Ukraine/Belarus forum, you have to use English.

 

As to what you wrote, that is a standard form letter, but an appeal is only possible if you can prove there was an error on the USCIS processing of the form.  That being said, I would not waste your time with an appeal based on what you shared with us, and have your husband submit a new I130 for you.  Lastly, I would dump the visa service, and do it yourself.

Every rejection letter say you can appeal.  However, you can only successfully appeal if USCIS made a mistake.  Here, the mistake is yours since you did not respond to the request for more information.  Your appeal will be deny.  Your immigration agency is horrible.  Refile the I-130 and answer all requests for more information.

The NVC will close a case after 1 year of no communication.  As long as you communicate with them before the year, the case will stay open for another year from the date of last communication.
