CAN I SEND THE EAD FIRST THEN AOS TO FOLLOW ?PLS HELP...

HI, ITS ME AGAIN. I JUST WANNA ASK IF I CAN SEND MY EAD FIRST THEN TO FOLLOW THE AOS? IF EVER IM GONNA SEND THAT EAD, WHERE WILL I SEND WILL THAT BE THAT ADDDRESS ABOVE U SENT ME? HOPE TO HEAR FROM U. THANKS. TAKE CARE.

K-1 Timeline

02-02-06 = met online

09-11-06 = met fiancee

09-27-06 = USCIS received File (NOA1)

12-07-06 = USCIS approved petition (NOA2) - sent to NVC

12-26-06 = NVC sent approved petition to Manila/assigned case number

01-12-07 = manila, US embassy received approved petition

01-18-07 = Manila, US embassy sent fiancee pre-interview notice

02-28-07 = K Packet received (US embassy:packet was sent 2-15-07)

04-10-07 = Medical

04-16-07 = Interview ( APPROVED!!!) -- Praise God!!!

04-27-07 = VISA in hand

06-08-07 = Arrived USA

07-21-07 = Church Wedding

AOS Timeline:

07-23-07 = AOS/EAD package mailed

07-25-07 = Package received at P.O. Box Chicago, IL

08-16-07 = Biometrics Appointement Notice in mail

08-24-07 = for AOS/EAD Biometrics in Hammond, IN

08-31-07 = NOA1 for EAD received / NOA1 for AOS received / RFE for AOS receieved

10-03-07 = EAD Card arrived in mail

10-04-07 = Filed for SSN (expect to get the card in mail by 10-18-07)

10-16-07 = SSN card arrived in mail

10-22-07 = AOS files transferred to CSC to speed up processing

11-02-07 = Applied for Indiana State ID (It takes 30-60 days)

11-10-07 = NOA for the Approval of Permanent Residence arrived in mail. No Interview (Thank God at last!)

11-17-07 = I-551 (Conditional Permanent Resident Card) arrived in mail. Praise the Lord!

NEXT STEP:

1.) Remove Conditional Status after 2 yrs. Form I-751

2.) Apply for Citizenship after 3 yrs. Form N-400

PRAISE THE LORD FOR ALL HIS BLESSINGS

You came to the U.S. on a K1? If so, then no, you are not eligible to apply for EAD until you have fulfilled the terms of the visa (got married within the 90 day period) and have an AOS application pending. Typically people send the EAD application (I-765) in the same packet as the AOS application (I-485). Your eligibility for the EAD is due to the fact that you have an AOS application pending.

Some POE's may give an interim 90-day work authorization stamp when you enter the U.S. as a K1, but I believe only JFK airport does this now. Regardless, it's only valid for as long as your K1 is valid, so it's pretty much useless.

Read the guides for K1 AOS...it will make things much clearer!!

K1's file AOS/EAD and AP (if you need to travel before AOS is approved) all at the same time. You cannot apply for the one year EAD before AOS has been applied for.

Temp Ead, yes. But it will expire when your I-94 expires. Other than that, it has to be filed along with your AOS.

Temp EAD for K1 is only granted at POE, so if they didn't get the stamp when they entered the U.S. then it's not an option for them I don't think.

Timeline

We saw an immigration officer about getting temp EAd even after receiving it at POE( it was going to expire before my husband got one year one), she told us that you can apply for it just after arriving. The only thing is it is temporary... just like the one at a POE. It will expire when the I-94 expires.

Assuming you did not get it at POE and you apply, you will probably receive around the time your I-94 will expire anyway. That is why I know that if you want temp EAD, getting it at POE is best.

That is correct. Filing an I-765 without an I-485 under the category A6 for K1 holders will get you an EAD that is valid only through the expiration of the I-94. Filing an I-765 with an I-485 under the category C9 for adjustment applicants will get you an EAD that is valid for 1 year.

Indeed, and given that the I-94 expires after 90 days, and EAD takes about 90 days to process, its basically pointless filing for an EAD under A6 if you're here on a K-1.

I always laugh when I read any posts with the numbers and abbreviations in it. Not because I find them amusing, but because a) i actually understand them now and B) my dad

was career Air Force, so I grew up with acronyms :-) and c) I always want to throw in random letters and numbers just for kicks and giggles.
