DCF with Online Marriage (Utah)

We are getting married Aug 24 via Utah.  We are both together in Cambodia.  I've been here over 13 months.  I'm planning on trying for emergency DCF on the basis of my mother's failing health and that she is the one that watches my children most of the time.

Below is the proof I was planning to provide.  Any comments about them or on other things I should start gathering?

- Copy of all 4 children's birth certificates
- A letter from my mother's primary care physician
- A map showing the location of the house I recently bought, my parents house, and their school in the middle (we only looked at houses within 30 min of their school)
- Something showing my 2 kids enrollment at the school
- An affidavit from my mother
- Something showing that one of my children has down syndrome

I  have not heard of this as a basis for DCF, please let us know how it goes.

If it is a real emergency, you can return to the US alone.  Your wife can follow after the visa is issued (DCF or non-DCF).  I don't think I have seen this rationale used, either......but good luck.

Yeah, I figured can't hurt to try.  Plus was gonna send 2 more emails to them before then about my prior issues. I'm hoping they see this as a way to get rid of me, hahaha

 

But also with COVID I can't travel back here if I go home.

I can't do it without her.  In another month my work picks up to like 80+ hour weeks for several months straight.  I wonder if I should include that in the request to try to help connect dots.  Still a long shot though.

Think of it from USCIS perspective.  MANY single parent do this by using family members, friends or hiring outside help to care for children during work hours.  Wanting your wife to join you to assist in the care of the children sounds more like a convenience rather than an absolute necessity.

DCF is not an option anywhere right now except for exceptional circumstances. It's up to the Embassy to decide on each applicant's situation if they qualify or not.

that message was from 2012 and i assume cambodia stopped DCF back then

but anyway,  to OP ,  can't do DCF at this time

I think the OP can still try and ask the Embassy, if one of their children has a disability as mentioned above and it causes undue hardship on the applicant, doesn't hurt to try and ask the Embassy for an exception. OP has nothing to lose by asking.

 

The info from 2012 isn't really relevant here as DCF is technically available at any Embassy if they approve you for exceptional circumstances.

Thanks for all the input.  Another reason for doing it is to see if they say anything about my Utah marriage to see if that is going to be another battle with them.  I know USCIS doesn't have an issue though.

Let us know what they say, it would be helpful for others here to know since the Zoom marriage thing is becoming more prevalent given the Covid scenario.

Isn't it where if I were being transferred from a job or if my mother was dying and needed urgent care that I can bring my wife?  If so, then it would be the same in my case.  I think my bigger issue is if they even consider it an emergency.

Where I live it's really rural so everything is going to be much more difficult.  But yeah, I could have my mom stay with me and help a few days a week.
