Hello,

 

My partner is currently in California on a TN status, we are originally from Canada. I am currently still in Canada but I am going to visit in a couple weeks. I will be staying for a month before returning back home. During my stay, we are planning on getting married so we can start the process for the TD status. After the month, I will return home to wait for the application to go through so I can cross the border officially. 

 

I am flying down when I go visit and I have been feeling anxious about cross the border. The cause of the anxiety is the amount of baggage I will be bringing over the border. There were a few items he could not bring with him, when he originally moved, due to space restrictions so I will be bringing them with me.  I am bringing many household items that make it seem like I am moving to the states but in reality I am just bringing them down to him. I fear that the border agent will assume I am trying to pull a fast one and move into the US under a cover of visiting a boyfriend.  

 

I have my return flight booked and I have travel insurance for the dates that I will be in the US. I was wondering if there were any other documents or other suggestions of things I could bring with me to prove that I am just visiting even if my bag say other wise? 

Any suggestions would be great.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Get a copy of his TN visa, you need to show who the items are for and what status he has. If you get a copy of his visa it will help you tremendously.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Not a problem. I will post my second question here. 

 

My partner is a Canadian and I will be visiting on a B2 visa. Are we able to get married in the US when I go visit? I will be returning home after my stay and waiting in Canada for my TD paperwork to come through. 

 

I know there could be potential issues with me coming down to get married even with the intention to return. I know many people come to the US and tell the guards they will be coming home and in reality the plan on staying. Are we able to get married and if so what can I say or bring to the border to help prove that I will be coming back home.

Bring thorough ties to home, including (if possible/relevant) a letter from your employer stating your expected return date.

What do you mean by wait for "TD paperwork to come through"?

  • Canadian citizen spouses and children may obtain TD visa status directly at a U.S. port-of-entry.  
  • TD status may be obtained either while the principal application is applying for his/her TN visa status, or after that individual has already obtained his/her TN status.
  • Family members should have the following items to secure their TD status:
    • A valid, unexpired passport for each family member. (Canadian citizen children under age 16 entering by land or sea from Canada may present an original or copy of his/her birth certificate, or a Canadian Citizenship Card.)
    • Original marriage certificate plus certified translation if not in English (spouse).
    • Original birth certificate listing both names of parents plus certified translation if not in English (children). 
    • Copy of the TN visa worker's valid I-94 record (if seeking TD status separate from TN visa worker).
    • Suggested: Recent letter from TN visa worker's employer and/or recent pay-stubs confirming his/her TN employment (if seeking TD separate from TN visa worker). 
  • Following review of the family member's documentation, the inspecting officer will issue each dependent an I-94 record under the classification symbol TD for the same period as the principal TN visa worker.
  • If a family member's passport is valid for less than the time granted to the TN visa worker (up to 3 years), CBP will issue an I-94 card with an expiration date coinciding with the expiration of his/her passport. INA § 212(a)(7)(B)(i)Inspector’s Field Manual § 15.2. Prior to this expiration date, the family member must renew his/her passport to obtain a new I-94 record. CBP will issue a new I-94 card for the duration of the TN visa worker's initial approval period after the family member has returned to the border with the new passport.

Yes, but we need to get married and have a marriage certificate issued before I can cross the border and initiate a TD.
