Why US based employers does not sponsor H1B visas?

My son is a software engineer in Silicon Valley, where there are huge volumes of venture capital/startups who are small and tend to recruit new grads locally from Berkeley and Stanford.   There is also a lot of lateral movement in the industry, so they poach employees from each other regularly as well.

there is a quota of 65000 for new H1B's per year. the application process is through a lottery system as there are a lot more applications per year than the quota that is available. most companies would not bother sponsoring for it, as it is an expensive process for employers and requires dedicated legal resources and luck (because of the lottery). I had the H1B visa for almost 9 years and know a few people who have gotten it last year so its definitely still a viable option. Although a lot of US based tech firms (Amazon, Microsoft etc) have offices in Canada as well now and offer an option to relocate to their Canadian offices in case the H1B lottery does not work out.

the main hurdle for you would be to get a job offer from any of these companies, not the Visa itself. the bar is high and it is very competitive

I am an IT Recruiter and there are companies that sponsor H1B’s. These are consulting companies and you would be assigned to work on contract basis for companies that have a need for Software Engineers. We sometimes work with these companies to fill IT positions. Check out these companies: Infosys, Cognizant, Tata Services 👍🏻

This is a great idea, if there is not any quota for the work visas in Canada, that can be real chance to migrate to the USA through Canada. Thanks a lot, I will look for jobs in Canada as well :)

It’s generally a lot easier to immigrate to Canada than the US.

Once you’re a Canadian citizen  there are some options for working in the US under TN visas

migrating from Canada to the US follows almost the same process as migrating from any of the other country. you will either need a qualifying relative who can sponsor you or an employer. Although Canadian citizens can be sponsored by the employers on TN instead of H1B for the STEM occupations i believe which would not apply to you at the moment.

Yes OP, definitely try - lottery winner here! Make sure you only enter via the official website (entry form not up yet but will go onto https://dvprogram.state.gov when it is)

Having permanent residence in Canada will not enable you to live or work in the US.

 

Your chances of immigrating as a Canadian resident are no different than your chances of immigrating from your home country.

My husband and son are both computer engineers, my son is a software/firmware engineer. There is no shortage of them in this country and it's highly doubtful any U.S company will sponsor someone from another country and spend all that money when there are an over abundance of engineers already citizens and GC holders. Unless you have some highly specialized skill with  graduate degree that no one else has(doubtful), your chances are slim to none.

Queue for review and approval. Already in line for Oath Ceremony as of Feb 13th, 2024.
NOA as of 4/29/24 - Oath Ceremony scheduled for May 30th in Chattanooga, TN. Rescheduled as of May 2nd, 2024 by USCIS - new date is May 29th.
May 29th - Naturalized! Ta-da!
