so, im very tired, which means i probably shouldnt reply at all but im going to

 

if he doesnt want to live HERE...

 

why aren't you moving there? i mean, have the kid here if you want (i certainly would). but after kid is born, move there, do whatever you need to do to be legal there, and then if you decide later on that you want to move to the US... do it then.

 

am i missing something?

Their plans have now changed. They will now live in Brazil.

It's simple in their case because she's a dual citizen. Thus she can easily live there whenever she wants.

My concern was just to make sure that a canceled I129 won’t affect his entries as a tourist - I wasn’t sure if that would raise red flags.

 

Our plans changed after pregnancy - we wanted to live in the US that’s why I had applied, now we’ll mostly be in Brazil but want to make sure we can come visit here whenever - that was my only concern, that he can come and see his daughter if I choose to spend some time here and he’s in Brazil.

 

I just want to do things the right now, the K1 made sense when we were just planning marriage and no baby to think of.

Possibly, I mean he's demonstrated previous immigrant intent. It is not cast in stone and a reasonable consular can evaluate and see that he does no longer has immigrant intent. It is a bit of a gamble however if he is a successful person in Brazil, that would tilt the scales a little more in his favor.
