Help - Multiple I-130 forms or one?

Timeline

Hi there! I am a green card holder about to petition for my spouse and our 3 kids. Question - do I need to do 4 separate I-130 applications?

 

If yes, will they all get approved at different times? So I then need to create 4 different NVC applications? How can I make sure they all attend the interview at the same time?

If you plan to still be a green card holder by the time they can get visas, one i130 for your spouse and (under 21) children as derivatives is the way to go - cheaper and you know they will have the same interview.

 

If you plan to naturalize before the process is completed you should complete separate ones (as your spouse case would be upgraded to an IR petition, which does not allow derivatives).

 

If the children are over 21 they have to each have separate petitions regardless of what you plan to do about naturalization.
