Fiance Interview Outside Country of Origin

Hello,

 

I recently received my NOA2 from the USCIS (July 26, 2021) and am now waiting for a case # to be issued by the NVC. My fiance is South African, but she has recently moved to South Korea as she wanted to work while we were waiting for the Visa to process. Is it possible for her to be interviewed at the Consulate in Seoul instead of in South Africa?

 

If so, how do I go about facilitating that? Can I change her address of residence with the NVC? How soon can I do that? I know the waiting period in between NOA2 and NVC case number is about 30 days, should I begin calling them at that point?

You need to intercept it as soon as you can.

Okay, thank you so much, can you advise the best way to go about this? I was out of the country and did not receive any digital notices from the USCIS otherwise I would have taken care of this sooner.

 

As long as I intercept it would there be any issues with her interviewing in S. Korea?

Yes she can: https://fam.state.gov/fam/09FAM/09FAM050404.html "Department regulations provide that a post must accept an application from an applicant physically present in the consular district even though not a resident in that district, provided the applicant expects to remain in the consular district throughout the several months that it normally takes to process an application and can legally do so."

You will be required to provide evidence supporting the change of venue and then they will decide

Okay I see. Would an offer letter or an employment contract be sufficient for this?

Okay great. I will contact the NVC as soon as possible then. It seems that their phone service is down at the moment. Thanks so much for your help.

Since you will need to submit evidence,  I would start immediately by submitting an inquiry form (Google "ask nvc").  Then continue to follow up via phone

Hello,

 

I spoke to the NVC regarding the above issue and they indicated that in order for a change of venue to be approved the applicant will need to show proof of "permanent residence" as opposed to "temporary residence" that would be a result of a work visa. Do you have any experience or knowledge of a change of venue being approved without proof of permanent residence?

In the case that the change of venue were not approved, or if the case gets sent to Johannesburg before the inquiry is processed, what is the timeline for requesting a case transfer from Johannesburg to South Korea?
