What documents are necessary for IR2 visa? (merged)

Timeline

Hoping someone can help. We recently had the consulate interview in Mexico for my two stepchildren coming into the US. I am an American citizen and the petitioner for them. On the first interview the documents were reviewed and the officer marked that everything was good. Their father accompanied them on the second interview and they were denied because they wanted original divorce documents (not copies) for me (the petitioner), original birth certificate (not copy) for me (the petitioner) and a Mexican passport for me (the petitioner who is not Mexican and doesn’t have a Mexican passport). My husband tried to explain all this to the officer and the officer wouldn’t listen and handed him a blue paper stating we lacked all the above and were denied!!

We could not go back into the Consulate again without a pass (which was not given to him) and all the information windows were closed. After spending thousands of dollars in hotels and airfares, needless to say we were extremely sad and extremely angry. What can we do to complain and/or corrected? The officer also asked my husband questions he was asked in his K1 visa years ago like how we met..nothing related to an ir2 interview. He also told my husband and daughters that very few ir2 visas are approved!!

Suggestions and comments would be greatly appreciated!

Have you tried submitting the documents requested on the 221g that you can get?  There is not a lot you can do to 'complain and/or correct' until after you have submitted the documents they want.

 

Btw, why did they need two interviews?  And if they are minors, is it possible that their mother has not given permission for them to immigrate?

I doubt the first appointment was actually an interview.  It was most likely the appointment for biometrics and document collection, as they normally do 2-day appointments for immigrant visa interviews in Mexico.

Does the paper list the specific documents that they are asking for and the instructions for submitting them?  Can you post a picture of that blue paper with all your personal information and case numbers redacted?

 

Also, I understand you're a USC, but have you ever in your life had a Mexican passport?  Just trying to make sense of why the petitioner's Mexican passport would even be requested.

The mother did give them permission to immigrate. In Mexico after you do the medical and the biometrics you do 2 appointments now. The first appointment is basically so the consulate officer can review your documents and make sure everything is there. He gives a “pass” and approved with an interview time for the next day, The second day it was a different consular officer who completed ignored the pass and asked for documents that are not required. I can’t even submit a Mexican passport when I only have a US psssport.

Right.  I would submit your US passport instead, but as far as asking for documents that are 'not required,' that is discretionary per the consulate, so if you want the visas, you will need to do that.

I have to say this sounds odd, particularly the comment that

(Why on earth would that be? They should be very straightforward in most cases)

but not sure what you can do about it other than give them the documents they want and explain that as a petitioner  USC you do not have a Mexican passport.

Also, it's not true that very few IR2 visas are approved in Mexico.  Just for the month of June, Ciudad Juarez issued 760 IR2 visas, making CDJ the top issuer of IR2 among all US consulates worldwide.

I am in the same scenario in Kenya right now. My daughters are 7 and 5, had their interview,  was refused since I did not have divorce certificate and death certificate from my husband's previous marriage.  My husband has to get a divorce decree from the court house, a copy but certified?????? Wondering what will happen, since I mistakenly sent a copy of death certificate instead of original of which I was asked to resend originals. I am also wondering does the certified divorce decree from the Chelan County court be denied as a copy ? That's all the county court can give us as original.  ...... am just stranded. Does anyone know if the certified divorce decree from the county court qualify as original? It's certified from the court house. Anyone with experience? Am in dilemma because that's all the court can give us

Has anyone had an experience where you brought all documents to the interview  requested in advance by the Consulate and the Consulate Officer wants even more than what you brought?

I am the petitioner, a US citizen applying for for an IR2 visa for my two stepchildren to come to the US. I am very familiar with the process because I applied for an immigrant visa for my husband and another stepdaughter previously and I knew enough to ensure that every single document requested by the Mexican Consulate had to be exact. But the Consulate Officer in CJD sent us away requiring an original birth certificate for me and certified copies of my divorce decrees, as well as my Mexican passport. Obviously he was confused and didn’t read the petition enough to know I am the US citizen petitioning for my daughters. In following directions in advance from the Mexican Consulate I included in the papers a copy of my husband’s divorce decree (the Consulate requested either OR  my husband’s or mine and also a copy of my husband and daughters’ birth certificates. There was nothing that should have made him suspicious about me. I am 74 years old with no criminal history. Confused, frustrated and angry!!

Per this post and several of your previous posts which were basically asking the same thing -- can they require documents not listed or requested in advance -- the short answer is, yes, they can.  It happens all the time.  From your other posts, i believe the interview occurred in August.  Have you submitted any of the requested information since then?  

 

FYI, the list of documents requested is the minimum that must be submitted.  The Consular officer can request any additional information and documents that he/she feels are necessary to properly adjudicate your case.   One of the reasons to request things like birth certificates, marriage, and divorce documentation is to ensure there was and is a valid parent--stepchild relationship that meets the requirements of US law and that the marriage was not solely for immigration purposes.  In the immigration world, it is somewhat unusual for a going-on 70-year-old to immigrate and marry a fiance who has children who are under 18 years of age.  (I say this not to be rude or question your relationship; rather, just to point out a possible concern of the officer.  I am basing this on what you have written in this and your other posts.  You said in a previous post your fiance entered four years ago and in this post that you are 74 -- I apologize if I misunderstood anything).

 

In a May post, you stated you had filed for divorce while the Removal of Conditions for your husband was still being processed and were asking how to drop your sponsorship requirements for him and your step-daughter who was awaiting a visa interview.  Did you follow through with any of the suggestions about notifying USCIS or the Consulate about the divorce and withdrawal of the support documents for the step-daughter?  If so, that would also result in requests for additional documentation that you have an on-going relationship with your step-daughters and do intend to support their immigration.

 

Many, many US citizens have a second nationality passport in addition to their US passport.  A request for your birth certificate (which presumably shows you were born in the US) would help clarify that you have no other citizenship -- assuming that is the case.  A simple letter explaining that you do not have, and have never had, a Mexican passport would also alleviate any other concerns.  Again, I am making the assumption that you have never had a Mexican passport, but you didn't answer a question you were asked about that in a previous post.  If you did, at any point in your life have a Mexican passport but no longer have it, a letter explaining when you had the passport(s) and why you no longer have it would be required to meet the Consular officer's request.

 

Regardless of your frustration and anger, the visa case will not move forward until you respond to officer's request for additional documentation. It is well within vIsa processing requirements for him/her to ask for additional information during the adjudication of a case.
