But anyhow, back to your question. Did you file your taxes on your own, or do you have a tax pro doing it for you? Because I’m thinking that if somebody else does them for you, maybe that person can write a letter explaining the situation to the officer handling your case, who -most likely- doesn’t know much about SS benefits. Or if you do them on your own, maybe you can resubmit everything again, highlight the SS income line, and also attach a copy of the manual that explains this.

Just to clarify, you might not be able to count the immigrant’s income because, in order to qualify, they must prove that the income will continue after approval. I’m not that sure how you’d prove that with a SS income.

Wasn't being sulky  just parodying a current commercial on the TV for Rocket Mortgage  

 

It was explained completely in the addendums on the I-864  and the I-864A.  The Social Security income is displayed prominently on the IRS tax transcript., just not on the "total income" line which only includes "earned income" The embassy was furnished the SS tax papers (like a 1099), in addition to the original SS benefits letters for 2021. The only way my SS income could stop is if I die so the income will continue equal to anybody else.  The embassy simply refused to acknowledge the SS income.

It is social security income. Why wouldn’t it continue?

So send a letter restating it and ask for a review by senior staff.  Immigrant visas are granted based on nontaxable income every day, all over the world.

It should continue, but maybe the officer can fight it saying it’s not like any regular job?

You mean a regular job in one of the 49 states with at will employment versus social security income that is specified by Congress and protected by the taxation  authority of the US government?

 

I’m really hard pressed to see the angle.
 

 I-864 specifically permits income from retirement. Social security is as secure an income stream as it gets. It only ends after all the USN carriers  have been sunk.

So before filing a formal appeal you suggest I contact the embassy re-stating our position on income with new copies of the SS documents and asking for a review by senior staff?  They stated we could upload financial documents. Would this be method be good in your opinion?

Again the officer repeated they could only consider the "total income" line on the IRS transcript, and not the SS income on the transcript

Yes it is scary. after some research I found ...The U.S. Department of State Foreign Affairs Manual Volume 9 – Visas, section 9 FAM 40.41 N5.5 part 4 b “Tax-free income (such as a housing allowance for clergy or military personnel) and other tangible benefits in lieu of salary are considered income. The sponsor bears the burden of proving the nature and amount of income.“ .. Is very clear that the consular officer must consider Social Security benefits in leu of salary. I will be including the reference in my letter requesting review by senior staff.
