Greetings everyone, 

 

First of all my apologies if I posted these questions in a wrong section. Namely, I would really appreciate if someone can help me out with suggestions/opinions/facts:)

I am about to apply for fiancé visa  (I am petitioner) so, I have 2 questions which I am unsure on how to answer..

 

1. Is it ok to mention in cover letter/love letter or whatever is official name for it:) that I met my fiancé (at that time as a girlfriend) in December 2020 since I have started divorce in California in September 2020, judge signed decree in November, but statutory period of 6 months expired in March. (I did explained that when we first time met we started off as a friends and later it evolved in a love relationship- however, I did not mention in the letter  we were married at the time we met,  for sure that will anyway come out on interview, and I didn't want to complicate in a written form, but rather it can be explained verbally if necessary)

 

2. Second part is connected with psychical address. Namely, my fiancé have permanent Austrian residency and Serbian passport. Last 13 years she lived in Vienna, however, since the end of December 2002 she is in Serbia at her parents house, due to all crazy situation with covid, jobs, etc...

Now, we will definitely put for mailing address address in Vienna, but, can we put physical address in Vienna too, or we must to put Serbian address as a psychical address?  The reason why I am asking is that we want to choose US embassy in Vienna for  k1 processing. To be more complicated, there is a possibility that she is back to Vienna due to job offer (after I submit application) or to go somewhere else in EU to work while waiting for visa to be processed. So, please, please advise on this part:).

To summaries, we want to choose embassy in Vienna for the visa processing, and in my understanding we must to choose embassy by place of residency, so, if she is currently in Serbia, can we still list embassy in Vienna for processing?

2.  For physical address purposes, does she still maintain a Vienna address?

1.  There is no requirement for such a letter.   If you are referring to the part about "circumstances of meeting " please look armt the size of the space provided in the petition.   This is an indication of the length of the response they are expecting. 

 

2.  Should be good.  She is visiting her parents but it is not her home

Nowhere in the instructions for the I-129F, or the form itself is this required or requested.

USCIS and the consulate understand that people start new relationships before their divorce is finalized.  What matters to them is that you are legally free to marry at the time you file the petition.  That said, there is no need to volunteer those details that would just complicate the description of the circumstances of your meeting.  Stick with pertinent facts, like when and where you met.
