plane travel in US w expired I-94

Hi,

My husband and I are flying to Florida next week. In his passport is the K-1 visa with an expiration date of May 27, 2007. The I-94 expired as well earlier this week on July 3, 2007. We filed for AOS but haven't received the NOA1 as of yet. Also he hasn't received the drivers license with picture yet. Will this be a problem at the airport?? His only picture ID is the expired visa in the passport.

You don't need a passport to fly domestic...only international. It's just my opinion, but I think the passport will be fine as far as identification purposes. However, I would call the airline and ask...to be sure.

he dont need passport to fly to Florida all what he need to enjoy his trip lol

but in case he need something to proof that he's here legal.

If you're concerned about being questioned about his legality, take a copy of the NOAs you've received, proving that you've filed for his permanent residency. Maybe even bring a marriage certificate, but I don't think you'll need it. I doubt you'll be questioned, however. You're traveling domestically and thus won't be required to go through immigration at all.

It won't be an issue because you won't be talking to any immigration officers. Domestic travel you will show your ID to the person at the ticket counter (won't check the visa) and the TSA person before the X-ray (will check photo, not visa). At no point will anyone check I-94 or Visa.

That said, its always good to carry your documentation on you while travelling just in case, you never know when you might bump into a Border Patrol agent for example, if you're visiting somewhere near a border.
