It's been a while she said. at least 4 to 5 years ago. She has been here for almost 12 years. But, hopefully it can still be done.

i was able to get a human on the phone in LA consulate ok. the thai consulate will only issue birth certificates for children born in US to thai parents. but they will provide the docs i need to send to the amphur in thailand to get a duplicate, thanks

i just got an email from the NVCNotice of Immigrant Visa Case Creation

 

in there it says

"You must follow our 12 step instructions posted at https://nvc.state.gov for completing your case. Once you have completed your case, we will schedule your case for a visa interview at the U.S. Embassy or Consulate General in BANGKOK, THAI."

 

this is no surprise as we indicated that on the I-130. I just want to reconfirm my original question that it is OK to file the I-485 from here now? i sent an inquiry to the NVC via this link  https://nvc.state.gov/inquiry to ask the same question but i have no idea how long it takes to reply and we need file file the I-485 within the next week for so or it will be less than 60 days until her current visit exit date hits

Contacting NVC is optional; i.e. not necessary. For example:

"our file - including some original documents - is still in Paris...We thought the USCIS would have to ask the Embassy in Paris to transfer the case back through NVC and that it would take weeks if not months. Turned out everything was already here in the digital form and was considered by the interviewing officer."

"Applicants and petitioners should not provide information or evidence related solely to the Public Charge Final Rule. That means that applicants for adjustment of status should not submit Form I-944, Declaration of Self Sufficiency, or any evidence or documentation required by Form I-944 when they file their Form I-485."
