I guess I didn't realize you could get that far in the N400 process without ROC.   And it seems odd that they didn't do a combo interview.

I honestly blame COVID: I think it causes delays in service centers who then fail to transfer the ROC case files to the field offices on time.

There’s NOTHING to do but sit tight. Your proof is the divorce certificate. The onus is on them to prove that your divorce certificate is fraudulent. If your divorce certificate is genuine, that’s it. They can verify they relatively easily.

If it’s not genuine (and there are countries where people do obtain fraudulent divorce , birth, marriage certificates etc) then you are in a world of hurt.

Good luck!

PS: You and your wife need to think deep and hard about your relationship. Trying to scuttle an immigrants immigration journey with false charges of fraud to me is a Red Line which when crossed, I don’t think I can forgive.

You know you can change your ROC application to a divorce waiver, right? Why would you want to stay married to someone who does such a thing behind your back?

1) Yikes.

2) Please be aware that you can file I-751 on your own if you are looking to get divorced by using the divorce waiver. The only thing that would be affect is your Naturalization application. Unmarried, you can only apply and be approved when you meet the 5-year PR requirement.

3) What your wife did could (will) cause some eyebrow raising on the USCIS side as she made a very serious allegation. Be prepared for some scrutiny.

Are you sure you want to remain married with somebody that went behind your back in such a horrible way and for the most childish reason?

I will like to find out what I can do to remove the condition on my green card.

I have been married to my wife since July 2016. I got my conditional green card in August 2017. I was once married and divorce with kids and she was also married and divorce with kids. My ex wife and kids are not in the United States and so I have to be remitting and communicating with my kids and their mum from time to time. My wife got jealous and she wrote a letter to the USCIS that I am trying to cheat the United States immigrational system and that I am still married to my ex wife. She did this in sept. 2018  without letting me know. I was due to apply for the removal of condition on my green card in may 2019 but prior to that i requested for my immigration files and that is how I got to know that she has written to USCIS about me because all this while, we were living together and taking a few trips here and there both locally and internationally. In June 2019, I filled out the form I-751 to remove the condition on my greencard and she gladly append her signature on the form for me that we are still married and I added all supporting documents that shows that we are married. In April 2020, we were invited for an interview but because of the pandemic, it was cancelled. Up till now my case have not been adjudicated on. we are still married living together and I have gone on to applied for naturalization. I have gone for the interview and have passed but waiting for the condition to be remove before I can complete the naturalization process.

I am planning to send current evidence of our marriage and letter to USCIS to prove that we are still married and living together under the same roof. I need your advice as to what I can further do to get my condition remove.

When was your interview (naturalization)? What is the status online? Did you have an AOS interview?

Did they request more information? Did they request more "proof" of marriage?

I don't understand.  If you are a US citizen now, why would you need to ROC??    That makes no sense.

He never said that he was a citizen.

You have to contact USCIS and advise that you have already passed the naturalization interview and now need the conditions removed.

Sending more paperwork does not help your case, especially since none was requested.

Passing the naturalization interview means nothing really.

I know this first hand, because I passed mine less than two weeks after an I-751 denial letter was received.

The underlying I-751 still has to be approved before they will proceed with the naturalization. It will remain pending until that is done.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks).
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE...
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time.
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case.
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied]

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) ....

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

2024: FML. Seriously. I'm done.
