My wife reported me to USCIS

I will like to find out what I can do to remove the condition on my green card.

I have been married to my wife since July 2016. I got my conditional green card in August 2017. I was once married and divorce with kids and she was also married and divorce with kids. My ex wife and kids are not in the United States and so I have to be remitting and communicating with my kids and their mum from time to time. My wife got jealous and she wrote a letter to the USCIS that I am trying to cheat the United States immigrational system and that I am still married to my ex wife. She did this in sept. 2018  without letting me know. I was due to apply for the removal of condition on my green card in may 2019 but prior to that i requested for my immigration files and that is how I got to know that she has written to USCIS about me because all this while, we were living together and taking a few trips here and there both locally and internationally. In June 2019, I filled out the form I-751 to remove the condition on my greencard and she gladly append her signature on the form for me that we are still married and I added all supporting documents that shows that we are married. In April 2020, we were invited for an interview but because of the pandemic, it was cancelled. Up till now my case have not been adjudicated on. we are still married living together and I have gone on to applied for naturalization. I have gone for the interview and have passed but waiting for the condition to be remove before I can complete the naturalization process.

I am planning to send current evidence of our marriage and letter to USCIS to prove that we are still married and living together under the same roof. I need your advice as to what I can further do to get my condition remove.

So are you still married to your previous wife?

And I don't understand - are you saying that you never did ROC, but somehow had a naturalization interview?   Normally you are not eligible for naturalization until the ROC has been completed, even if the processes are somewhat concurrent.

I am divorce to my previous wife. I have a divorce certificate to that. I already had my naturalization interview and passed but the only hindering me is the ROC.

I don't understand.  If you are a US citizen now, why would you need to ROC??    That makes no sense.

Obviously your wife is unaware of the consequences of her actions

She had to present your divorce papers to get your visa

this makes her a party to marriage fraud if you ,  in fact,  were still married and not divorced at the time of the visa interiew

and if ICE takes her serious she could also face a fine and jail time

You need to seriously consider that someone would threathen you just because of jealousy and either get into marriage counseling with her to repair this or consider removing yourself from her presence

And it is perfectly normal to have to communicate with former wife when there are children of the marriage

Penalties Faced by the U.S. Citizen or Lawful Permanent Resident Spousal Petitioner

The U.S. spouse could face substantial fines and even jail time if convicted of the crime of committing marriage fraud

your wife can SAY anything she wants but without PROOF it really means nothing, other than a massive headache for you. Presumably, you have proven, several times over, that you are divorced from your ex wife.

if I were you, I would also be divorcing the current wife. But that is me.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

He filed for ROC within the 90 day window, was later given an interview date that was cancelled due to the pandemic in 2020. That's the last he heard about the ROC. Since then he has filed the N400 AND passed the N400 interview, but can't become a citizen because the ROC is still pending. It's all there in his original post.

Well, if ROC doesn't work out, you should get your citizenship August 2022. 5 years after you received the green card.

You cannot get citizenship if denied ROC

I guess I didn't realize you could get that far in the N400 process without ROC.   And it seems odd that they didn't do a combo interview.

Not all field offices conduct combo interviews, it is to their discretion.
