Hello, Everyone! 

 

It has been a long time since my last post. I have been scrolling though some posts and I have A LOT of questions. 

 

I applied for my 18 month extension letter in December 2020. I received it in February 2021 (Great news). I was under the impression that I am currently in the waiting period to receive my 10 year GC. After reading some posts I noticed a lot of people were saying I could apply for Citizenship after 3 years of marriage. I got married February 2018. Is it possible for me now to apply for Citizenship?  I thought I had to wait 1 year after receiving my extension letter to apply for citizenship. 

 

Any advice would be greatly appreciated, thank you so much!

3 years after your permanent residency starts if you are married with an US citizen. Is not from the date of your marriage.

 

For what I can guess you arrived on 2019, so you can apply in 2022

This is what I thought and why I was a little confused, Thank you for your reply. Quick question, Can I apply for citizenship 90 days before the 3 year GC period?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Essentially, if you meet all the requirements for the 3 year rule to file the N400, you can file the N400 about a year after you file the I751 (but check the calculator to make sure as if you file early, it will be rejected).  If naturalization is you eventual goal, there is no downside to filing the N400 and get that clock started.

Wouldn't it be denied as it is not in the 90 day period?

Yes, check the calculator, or simply look at the "Residence Since" date on your GC go out three years and count back 90 days on a calendar.  It is recommended to not file on the first day the 90 day window opens up especially if filing online as there was at least one story where the computer dating showed the application being a day early as the member submitted it minutes after the window opened.  The member was eventually able to clear it up, but who needs that headache.

Wow thank you for the advice! I probably wont do it online because I have no idea how any of their websites work and I have had so much trouble with them in the past. Dashinka, would it be ok for me to PM you with another question?

Just look at the date on your greencard. Go forward 3 years and that’s your eligibility date for citizenship if you are still married to your original petitioner.. I would submit N-400 maybe 80 days before your eligibility date just to get in the right window for submission. It’s not going to happen immediately anyway, so hitting that 90 days exactly won’t matter in the grand scheme of things.

It's 3 years from whichever is last:

1. Date you became a permanent resident (resident since date on your card)

2. Date you married your US Citizen Spouse

3. Date your US Citizen Spouse became a US citizen

 

or 5 years from the date you became a permanent resident

 

Yes, the time you're a conditional permanent resident counts for either the 3 or 5 year requirement, and you can file N-400 while the I-751 is pending. You can file N-400 up to 90 days before when you meet the time requirement. USCIS will most likely summon you and your spouse for a combo interview for both of these, even if they don't mention that you should bring your spouse they should come regardless - if they're needed they're there, if not they can wait in the car, and if you get through the next step is taking your oath and yes you'll jump from being a conditional permanent resident to being a US Citizen.

If you file too early it'll be rejected rather than denied. USCIS will return your application package and your check or money order to you, G-1450 gets destroyed.
