The officer violated this policy by disclosing the petitioners criminal convictions and then refusing the visa.
 
 
 


It says it does not apply for k visas. So, in this case they didn’t violate any policy?

Aha, I see now way at the bottom under (d) it does say it doesn't apply to K-Visa and they follow IMBRA.  As yeah, it does contradict IMBRA which says it must be disclosed, plus contradicts the K-1 disclosure policy elsewhere.  So then I'm guessing this only applies to marriage based petitions.

 

I'll remove this from the list on my site, I have a bunch of other ones anyways.

I tried to edit my original post to add beside it that I was wrong about it, but seems can only edit recent posts.  Anyways, any MOD if they want to update it to prevent confusion I fully authorize you to put in red beside it saying I was wrong and can put it in first person (I was wrong about this, as it doesn't apply to K1 visas).

Post a petition for others to sign on facebook / post that link here and on every site u are on like twitter,  etc

An update on this, so I did file the complaint with OIG.  There is no confirmation number, no email sent to me that it was received, nothing.  So not much hope.

 

It seems like they don't actually look into complaints, but rather receive the complaints and decide if they will investigate and do a report or criminal action. 10/1/20 - 3/31/21 had 892 complaints to the hotline.  Hard to believe it's only 892.  It seems like 15% of the complaints result in some type of action, but kinda hard to say (could be more).  Actually not a discouraging percentage (I'd be happy even if all my complaint did was have the Embassy receive an email telling them to start complying to laws).  Also, it seems they are mostly interested in complaints where they can save money or that lead to a criminal case.

 

In any event it will be a LONG TIME before anything comes out of it (if anything) and for sure it won't help me out with my visa issue.  But still I think good to hold them accountable.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks for the tip.  When I check their website, travel.state.gov, I'm not seeing anyway to contact them about it or to submit a complaint.  I see an address, so I guess I could mail something.  Also, there is contact info for specific situations that don't apply to me (like Visa Fraud, or Emergencies).  At the bottom of the site it links to stateoig.gov which is the Office of Inspector General site that I sent the complaint to.

 

They do list numbers for NVC, so I will try to call them to complain (I've called twice and it just says they are busy, then goodbye) and I'll also call USCIS just to make the full rounds.  Also, I'll probably submit to GOA as it seems they would have interest as it shows they need to issue more training.

 

Anyways, do you know the what is the best way to submit the complaint to The Bureau of Consular Affairs?

You were very right.  I just got this email from OIG (and then it had a tracking number and mailing address for BOCA below it):

 

We are writing regarding the complaint that you submitted to the Office of Inspector General for the U.S. Department of State. We have reviewed your complaint and determined that the appropriate office to address your concerns is the Bureau of Consular Affairs, Executive Office. Your information has been forwarded to that office.
