Hello guys,
I did my IR1 visa interview March 24th 2021. During the interview the Consular Officer denied my Visa and held on to my Passport. I was told that a decision would be made in some days concerning the Visa.
Last 2weeks I got a call from the Embassy to come for another interview. During the second interview the Consular Officer told me base on the Ban still running i can't get a visa now but I am qualified for a Waiver. I should go ahead and apply for a Waiver then she returned my Passport to me.
I asked her what are my Options if I didn't apply for the Waiver. She(Consular Officer) told me I can as well wait till December 2021 for the Ban to be Over then I can send the Embassy Email 📧 My file will be Re-Open for a Visa processing.

My question now: Should I go ahead and applied for the waiver(Form I-601) or just wait for the next 5months for the Ban to be over. Please what are the my chances.
Have anyone experience same or waited for the Ban to be over. How long did it take for the Embassy to issued Visa after the Ban is over.

Thanks

Can I ask you that did you file your waiver?because I have a same case.

No. I chose to wait. The Ban is over. I called the embassy also send them email. I was asked to send in my Passort, medical and other document to DHL.

Thanks for reply. Can you please tell me what was the Ban?

In one of my visit to US I sold one of my sneakers for 50dollars to a friend. On my next visit to US at the Airport an immigration Officer went through my phone and saw my WhatsApp chat with my friend about the 50dollars sneakers transaction. The Officer said I have Violated my B1,B2 Visa. He cancelled my B1, B2 visa and handed me a 5years Ban. I was sent back with my return ticket.
