5 YEARS IMMIGRANTION BAN ALMOST OVER.

They gave you a ban for selling your own used sneakers to someone? That doesn’t really sound like the whole story tbh. Anyway it doesn’t matter, you just need to wait for the ban to be over. I doubt you’d get another B visa if you were in the position of wanting one, but there should be absolutely no problem with getting your IR visa.

I fully agree with everything you said. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Are you sure that was it? 5 years over $50? A lot of tourist come in and sell their stuff from abroad as it is considered "unique" here eg traditional bracelets etc. 

If the waiver is not 4 months as you said, then just wait for it to be over as others have said.

B1, B2 visa is for tourist and visiting not for business. Selling things for profit is wrong. When It comes to immigration rules alot of things can happens which we don't know. I pray no one meet an immigration Officer that is so mad. He/she can nail you at a little mistake. One of the mistakes I made was not applying for CRI visa with my wife. Then I wasn't ready to relocate to US.

Sorry, selling one pair of used sneakers is not a “business”, even if you make a profit on it. And they don’t check everyone’s phones, so something made them look. Not that it matters now ….good thing you’re not looking for another B visa.

Selling things for profit is good but do they declare it. US 🇺🇸  don't play with Tax. Not paying Tax is big problem. If immigration notice it is a big issue.

Who told you that immigration Officer at the Airport can't go through your phone. I may not be able to explain it to you but I will advise you when travelling with B1, B2 visa prepare for any thing. "Am sure you understand the meaning of "National Security".

That’s not how that works.   People here in the US sell used stuff ALL the time.   The money you get when you sell your personal items is not taxed as income.

Coming into 🇺🇸 from another country with Visiting or Tourist visa and selling things/ doing business for profit without paying Tax is different from when you leave in US and sell things. I guess you are talking base on you residing in 🇺🇸.

Well, to be fair- you did make it sound like the ban was due to selling a $50 pair of used sneakers.

 

As always , there is more to this story, and I suspect it may have to do with importing things, possibly counterfeit items.

Of course they can go through your phone, my point was that it is very seldom that they actually ask to do so, so something you did or said or something in your baggage must have made them suspicious

You implied it when you said “selling one of my sneakers” … so it was presumably a lot more than one 

 

and yeah now the story is coming out of what you were actually doing -  engaging in trade which of course is in violation of B status. It is not “one mad officer”.

Maybe I need to help you understand my situation more better.  I run my own business am into Building materials business. My wife( then my girlfriend) base in US 🇺🇸 I usually go to visit her.  In 2016 I went to 🇺🇸  4 times I never overstay or stay more than a month. Each time I travel my flight ticket is always on My Phone(Gmail) I don't print out my flight artillery.
On this day the Immigration Officer(an sorry for using the word "Mad Officer") ask for my return ticket I brought out my phone and showed him. He was kind of surprised how come I have visited the  US 🇺🇸 4 times in a year(already on their system). Don't forget he was still with my phone. He just went through my phone messages and WhatsApp chats.

To me selling sneakers for 50dollars I never saw it as an offense but to immigration officer is an offense. at that moment it all depend on what decision the Immigration Officer will make my case.

I believe this platform was created to help us share our experience, challenges and journey during immigration cases.
In as much as my story be sound so ridiculous to some people that does not mean that it did not happen. I think is better to learn from someone mistakes.

I can as well not to share my situation on this platform and keep it to myself and nothing would happen but choosing to share it can help me make the right decision and also help someone on this platform to learn.
On this platform I have read alot of immigration cases and it has help me understand US 🇺🇸 immigration system better now, am still learning

Nothing like importing counterfeit items.

I have come to learn something every immigration cases are not the same.  During my immigration interview the Consular Officer was so relaxed. She was the one advise me to apply for the waiver that my case is not a big issue.

It does not really matter.

 

I 601 is usually for a life time ban or overstay 3 or 10 years, seems in this case just the deportation? And presumably a 5 year ban.
