Hello guys,
I did my IR1 visa interview March 24th 2021. During the interview the Consular Officer denied my Visa and held on to my Passport. I was told that a decision would be made in some days concerning the Visa.
Last 2weeks I got a call from the Embassy to come for another interview. During the second interview the Consular Officer told me base on the Ban still running i can't get a visa now but I am qualified for a Waiver. I should go ahead and apply for a Waiver then she returned my Passport to me.
I asked her what are my Options if I didn't apply for the Waiver. She(Consular Officer) told me I can as well wait till December 2021 for the Ban to be Over then I can send the Embassy Email 📧 My file will be Re-Open for a Visa processing.

My question now: Should I go ahead and applied for the waiver(Form I-601) or just wait for the next 5months for the Ban to be over. Please what are the my chances.
Have anyone experience same or waited for the Ban to be over. How long did it take for the Embassy to issued Visa after the Ban is over.

Thanks

Apply for waiver

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Unlikely a waiver would be resolved that quick.

Apply for waiver

Okay. Thanks. Please can you give me more Understanding why i should apply for the Waiver. Reading that the Waiver( Form 601 and 212) takes between 4months plus to be approved or Denied which is around December. By December 19th 2021 the Ban should be over

4 months would be quick, the ones I have personally come across recently have been nearer a year but did read they had been getting faster, how long yours would take would be a guess.

If the ban is over in December I wouldn’t bother applying for a waiver. The cost and hassle involved for something  unlikely to be resolved by then doesn’t seem to make sense. Not sure about 4 months, FYI official uscis times to process i601 and i212 is 4.5-6.5 months. Best case resolution is not as good as just waiting for the ban to be over.

With an I-601? By the time USCIS approves it he'll be in US already, or they'll just deny it for mootness since the ban expired on its own.

Contradictions without citations only make you look dumb.

In one of my visit to US I sold one of my sneakers for 50dollars to a friend. On my next visit to US at the Airport an immigration Officer went through my phone and saw my WhatsApp chat with my friend about the 50dollars sneakers transaction. The Officer said I have Violated my B1,B2 Visa. He cancelled my B1, B2 visa and handed me a 5years Ban. I was sent back with my return ticket.

Applying for the waiver depends upon what your ban is for.  MIsuse of Visitor's visa, unlawful presense, or deportation, EWI.....

I view that as a very very minor infraction which should not have further repercussions. Just wait for the ban to expire.
