No response to my inquiry. The case is taking longer than the processing time.

Does anyone have a similar situation? I filed my case in March 2020, and my case is taking longer than the processing time. Then I submitted an inquiry on July 13, 2021, and received “On July 23, 2021, we sent a response to your inquiry about why your case is taking longer than our processing time, referral number XXX….” I also received a confirmation email that said “Expect a reply by August 4, 2021.”

However, I haven’t received any response from my account, email, or physical address until now (8/8). Does anyone know if they usually delay the response to the inquiry?

USPS is slow right now, so it could be delayed in the mail. The chances are it will just be a generic non-answer for their delay anyway.

I started sending an out of processing time request every month, just to keep the pressure on when I was in this position.

How did you send the out of processing time request every month? Is it online or is it physical mail to the USCIS office?

Please advise. Thank you.

You can do it online here:

https://egov.uscis.gov/e-request/displayONPTForm.do

Keep details of all the requests you make (and their responses), then if you do end up suing them further down the track, this will help to show that you made every effort to try and resolve it other ways.

Thanks, bing. Did you receive only the physical letter for the inquiry or you had a pdf letter for the inquiry on your account?

I did google and found some people said they have responses just within a week, so I thought I might miss the inquiry letter.

I've only ever received either an email, or more usually a physical letter, I've never had a pdf letter uploaded as a result of an enquiry.

Thanks a lot Bing. My office is Norfolk - and the processing time there is between 8.5 to 16 months. And since I filed my N-400 last September - I guess I am still well within the processing time window.

I sent a mail to the National Benefits Center last week on the advice of the USCIS phone representative. I will keep making requests every month just so that I do not lose my sense of sanity.

Thank you so much once again for the information.
