Hi,

 

I live in Germany where I have my residency. I am trying to visit my I family in the US, but my B1/B2 visa appointment keep getting cancelled. It was cancelled for the 3rd time now. I am frustrated and so my old parents who I havent seen for 3 years now.  There are no appointments available now in Germany. 

I checked that in Czech Republic- Prague there are available appointments. My question is:  can I apply in a country different than the one I live in??

You have to show residency of a country to qualify for B1/B2 from that country.... Beware of consulate shopping it has grievous consequences.. Wait until appointment is available to you in your country or residence. You also qualify for B1/B2 from your home country

I thought your case was in AP?

Yes, I do have a case stuck in AP, but the consultant sent me an email saying that the AP is finished and due to Corona Situation and the related Presidential proclamation the visa is refused. Thats why I am applying for another one 😢

If I am a third-country national living in Czech Republic, can I apply for a nonimmigrant visa in Czech Republic?

Applicants are generally advised to apply in their country of nationality or residence. Any person who is legally present in Czech Republic may apply for a visa in Czech Republic. However, applicants should decide where to apply based on more than just convenience or delay in getting an appointment in their home district. One thing to consider, for example, is in which consular district the applicant can demonstrate the strongest ties.

From all the above

 

1. You can try 

2. they may or may not let you

3. Chances of actually getting a tourist visa given you (1) already have a case in progress and (2) are from a COVID banned country are just about zero regardless where you apply

Uh.....     don't you think the same issues will arise if you simply apply again right after a denial?

Can you expand on the "grievous consequences"? I often see that people recommend to just give it a try, suggesting that there is little downside (other than time and money wasted). Do you know of situations where attempts to transfer to another embassy had a negative impact on the visa application process?

Well i did a little digging and also got permission from a friend to share her experience. 

A friend of mine a south african lived in finland, which is part of schengen for many years. She had a residence permit and one time she was in France with her boyfriend for months... They wanted to come visit me in new york... She and her boyfriend decided to apply for a visa at the US embassy in France... Her boyfriend got the visa but she was qustioned on why she did not appy in finland or south africa... And eventually refused. 

 

Now the DOS website stated that third country nationals  residing legally can apply for a visa.. She had a permit that grants her legal stay in all schengen countries for 90 days... However, she is not a resident in France. It is difficult for consulates to evaluate your intentions and ties to the country when you not a resident. 

 

On the other hand, immigrant visas can easily be adjucated in the same scenario because you no longer have burden to prove that you coming back. 

 

Your milage and luck might defer, if you have good reasons and money is not an issue.. By all means give it a try. What do you have to lose?.. Just have your story straight on why you are chosing to apply in a different consulate other than your country of residence or home country.

But from your post, i think the outcome will be the same... They have your case in the system and it does not matter which consulate you go to

Since you already in AP, pushing for this might look desperate and desperation and no immigrant visas dont go well together... All the best!

It seems this Consulate does not take Third Country Nationals, most currently do not.

The only reason I want to apply in another country is because they have available appointments, while in Germany there are not.

My old AP stuck B1/B2 visa was refused based on the email I got from Frankfurt consulate, so the only thing I can do now is to apply again .  I have no choice.. 

yes this looks desperate, and to be honest it is. I havent seen my family for 3 years now thanks to the previous travel ban and now the covid restrictions.

I want to secure an appointment, maybe by the beginning of next year. By then hopefully the COVID travel restrictions will change, which were the reason for the denial.
