Hello, 

 

The Ask:

1:    Is there anyway to be 100% sure in Colombia that she has a clean record?

2:    Should my mother in law file for a divorce before / during the petition for I-130 if she's been separated for 30 years ... or separated / divorce doesn't matter in the eyes of the I-130 (US GOV)?

 

My wife and I are going to start the petition for my mother in law (wifes mother). My wife is a US citizen now.

 

My wife mother thinks she was charged with a drug crime aproxx thirty years ago but when she request her criminal records for employment her records always comes up clean. 

 

In addition, my wifes father left them when they were young, ~20 years ago, and her mother never filed for a divorce. For the I-130 should her mother file for a divorce? or does it matter between separated / divorce check boxes?

 

The Ask:

Her husband at the time had possession of a drug and because she was with him she believes she was also charged and had to pay a fine. It’s possible the charges was just on her husband? And he lied to her saying she was also charged and had to pay the fine? I don’t have a clue and was wondering if someone from Colombia knows a way to find out? Compared to going to her local government facility maybe there is somewhere in Bogota she can pull her official criminal record? Meaning …. If that comes up comes up clean …. Then she’s clean TBD.

 

I agree, in case it comes up in the interview she needs to try and remember as much as she can regardless if it’s on her record or not. My intention is to confirm with 110% certainty if she even has a criminal record in Colombia, maybe we need a waiver before filling the I-130? No clue, hence wondering where she should go pull her official criminal record in Colombia to be 110% positive.
