Hi all!

I have a concern and I hope to find some advice in this forum...

 

My husband (US citizen) and I get married this year in May, in June we started the CR1 visa process sending the I130 and I130A forms.

I'm currently in the US, I came almost 6 weeks ago to visit him before I start my Master Degree in Spain in September, but for family problems about the limited apartment space and receiving the notice that my mom can't take care of my old dog (so she will need to be with me and she can't go to Spain so the option is to bring her here), my husband and I are starting to think in the AOS as an option, is it possible and recommendable? is it easier the filling documents and process? how long will be taken us the whole process?

 

I have my personal doubts, I did all the process for the student visa, enrolled the Master and have my ticket to Spain... but for the other side waiting so long for the CR1 process (1.5/2 years?), being apart with no chances to see each other for 9 months, also my dog, I really do like the idea to bring her and starting our life as a family... So as u see I have really intern conflict... I also not sure about having a second master's in Spain, is it going to be useful to get a job here? I am doing one now, this second was most for the possibility to be in Spain with my family while the CR1 was in the process... maybe is better just to do a specialization here?

 

My husband is excited about this idea and I am starting to, so I really appreciate some advice... I have my ticket to come back to my country this Monday..

I am also concerned about whether it is possible, and how long it takes to obtain permission to travel to Spain during the AOS?

About 6 to 8 months.

It varies per FO. Some offices take more than a year.

I-864 is filled-out by the US citizen, and the rest of the forms are filled-out by the immigrant. In general, send the following three packets (*note that I-765 and I-131 packets are optional, but highly recommended) in the same envelope to the Chicago Lockbox:

  • I-485 with I-130 receipt notice, I-864 and supporting documents, electronic I-94 copy, filing fees, etc.;
  • I-765 with electronic I-94 copy, etc.; and
  • I-131 with electronic I-94 copy, etc.

On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.

Timing of the Submission of the Medical Examination Report

Applicants may submit the Form I-693 medical examination report to USCIS:

  • Concurrently with the immigration benefit application; or

  • At any time after filing the immigration benefit application but before USCIS finalizes adjudication of that application. If not submitted simultaneously with the immigration benefit application, applicants may bring the medical examination report to an interview or wait until USCIS issues an RFE requesting the medical examination report.

 

Here is the I-693 courtesy letter: "DO NOT MAIL DOCUMENTS AT THIS TIME."

Thank u so much for your response! We started the CR1 process online and it was automatically sent to Potomac 😔 Do we need to send the AOS package to Potomac? or we can try to send it to some faster USCIS?

The I131 will be free because I'm doing the AOS? or should I need to pay the $575?
