We had what feels like a huge break through for us this morning!  After the drama of having to send a DS-5535 after being initially approved, my wife's visa status flipped from 'REFUSED' to 'ISSUED-administrative processing" after ~1 month.  We are so happy and are celebrating today!

Gongrates, what was the reason behind this the form Ds-5535, did you have to hire a lawyer for it or you just submit it and wait ?

Had the medical with Dr Mascarenhas today and it went very quickly. Super friendly and office staff was very efficient. Between the wait time, x-ray, and blood work it only took a little under an hour so I was very pleased. It was my last step to complete before my interview next week. I'm a bundle of nerves! Hoping to have my police clearance back in time for the 3rd... crossing fingers!

Anybody who already crossed have timelines for how quickly your greencard got sent to you? I’m on day 84 since I entered the USA and still no update on my card production.

We have no idea what triggered it, we still don't know

On the FAQ it says the form can be required due to "education/travel history" (though I can't imagine that's it as we've only traveled between US and Canada over the last 5 years, and we're 10+ years from university days).  Our attorney said "This is standard processing for cases that have been pending at the embassy for a while.  The DS-5535 is to update the application with new information since the processing of the case has taken so long."

Our theory is that enough of our contact information had changed that may have triggered it.  Our home addresses changed, my phone number changed, I got a new job, etc.  But that's only our guess

So there is a mistake in the QR code that was put on your birth certificate?

You can depend on the Indian government on making such mistakes 🙄  (speaking as an experienced Indian Citizen)...

Well, considering your DQ date, your interview is very likely to be scheduled in October 2021. That doesn't leave you with much time.

Birth certificates from most countries do not usually have QR codes on them (mine doesn't), so I do not think the consulate will be checking teh QR code. They will be verifying the written info on it. So in all likelihood you should be fine.

I am not sure what is the process to get a correction on your birth certificate or a new one, nor the time it takes to get done. My advice - Apply to get it corrected (if it can be doe without you flying to India). If it gets done on time, great, if not, go with the certificate you have, and you should be fine. If they ask for a new one, you have one on the way.

Regardless, even if the current certificate is accepted by MTL, it makes sense to get the certificate corrected for future use.

Thanks for replying sorry i think you didn’t get my question

i have original certificate which is laminated but was accepted by NVC

now i got to know that laminated certificates are not acceptable (maybe i’m wrong)

and I applied for new one from india and they gave me certificate but it looks like a photocopy not as the original one i have ( laminated)

and on the new certificate they have QR code i know that consulate won’t check the QR code

so that is why i was confused would they accept it or not I don’t want to be in AP as already been 2 year’s in this process and getting an AP would shatter me down

Oh OK. Sorry, yes, I did misunderstand your question.

I think you are overthinking it. you received an original birth certificate directly from the authorities, yes? It doesn't matter that it "looks like a" photocopy.

Chances are you will be fine. I also don't see what more you can do at this point, as should you get another birth certificate, it will look exactly like the one you already received. If MTL has a problem with either certificates, they will need to advise you what to do.

We're "ISSUED-final processing" <24 hrs after "ISSUED-administrative processing"!  So glad this forum exists to help people along the way with this stressful process

GREAT NEWS!

As I am leaving the airport to return to Canada after visiting my wife for a month (hardest goodbye ever -they never get easier) - we get an email saying our expedite request was approved (DQd April 30th 2021) and is in transit to the embassy. I just called my wife and we are just ecstatic. We got notice last week it was under review.

Now I am on my way back to Canada and time to prepare for the last stage.

We do have a question, because the email from NVC says "The Embassy/Consulate General will contact you soon to schedule a visa interview"   but then when we go onto CEAC to check status it says "Your case is in transit to the Consular Section. Your interview date was provided to you by the National Visa Center".

Am I supposed to wait for them to contact me for the interview date or is there somewhere I should be looking?

Thanks to all and best of luck to everyone!

Mel

Thank you so much! And you remembered correctly.  I already had two roundtrips booked for the rest of the 2021 year to be with her but turning one of those into a one-way ticket will feel amazing.

Thank you again! We will update everyone and timeline when we get IL.

- Mel

So happy for you that your expedite request got approved. Folks at MTL may have a heart after all...

Do update us as your interview gets scheduled. Best wishes to you and your wife.
