Hi hope all is well.

 

My wife just realized her Canadian drivers license has expired. Her passport is valid and she has a US Dept of Defense ID as well. 
 

She is currently waiting with me in the US. Does anyone think she needs to travel back to get her ID renewed before the interview?

Timeline

I went to my interview in Montreal on Friday morning, and got the 221(g) form, due to administrative process. Needless to say that my 5 hrs drive home and the whole weekend, my heart keeps sinking deeper and deeper, acclaimed to every minute passing by. This morning, I checked my status and it got updated today, Jul 26, and still “ Refused”. The big red painfully wording!

During the interview, among the regular questions that occurred to most folks here, which are:

- what is your petition name? where does your petition live? address? is this the address that you will join him/her later on?

- where and how do you two met?

- what kind of job your petition do? what kind of job you do?

- where did you get married? who were there?

- in the last 5 years, where had you been travelled to?

- have you ever overstayed in the State before?

- did you ever get turned around at the border? reason?

The last question is the one that stoked my interviewer to decided he needs more investigation, since I did get turned around at the border, one time before I filed my DS 260, which I had included, and one more time - after I got DQ’, during the most restricted covid time, which I had not include in my DS 260 ( because you just can’t change this form afterward). This sits uneasy with me and eating me inside out. 

This morning, while I am reorganized all the documents returned to me after the interview, I found out they had kept my original form of RCMP Criminal background check. is this a normal procedure? I am seeking advice/consolation if anybody had similar experience. Please and thanks. Please also don’t sugarcoating, to prepare for the worst scenario, even though it is against my will.

I don't have real experience of this, as I am still waiting for interview. But there were a couple of cases if you read the last several pages where people were handed 221 (g) form due to them being turned around at the border when trying to enter the US, but they appear to get resolved fairly quickly and eventually get approved. One even got approved in just a few hours. In the interim, their status shows "refused".

 

Hopefully this is what will happen to you too, and you will get approved by today or sometime this week.

 

That being said, there are cases were people are put into AP for months (or even years) but that is not usual for people born and residing in Canada. Were you born in Canada? Do you have any history in any other countries (such as other citizenships or resided elsewhere?)

I was not borned in Canada, but reside here for over 30 yrs. 

My last name is a common last name in my country and almost 10% of the population carried the same as mine.

OK, which country is that? Mostly being born elsewhere is also not an issue. It is only certain countries that get flagged. But then I think these people get asked to submit a DS-5535 form, which I understand you didn't receive?

 

Also your description makes me guess you maybe from an East Asian country such as South Korea or China. These countries don't get flagged normally as a far as I know. 

 

Did the CO say anything to you about why you were refused? If not, perhaps email the consulate and ask? Again, if it is just because of being turned around at  US border, it will likely get sorted out quickly.

My interview was at the same time as you. I think we met outside and talked a little bit. I'm also in AP and mine was also updated today with refused. I don't know what your interviewing officer said to you but mine kept my passport and said that there shouldn't be an issue with issuing the visa after they check out why I was refused at the border. He kept my passport for that reason. Did they keep your passport? I think I could overhear your interview during mine and it sounded like you had a real hard a**. Did he tell you anything?

Depending on your country of citizenship or connection to, it is possible you could have a lengthy AP, but that is no guarantee. Sounds like you were put in AP because of the refused entry at the border which is standard procedure as they have to make sure that CBP didn't discover any inadmissibility that would impact your immigrant visa. Did they hold on to your passport at all?

I would take it as a good sign if you weren't asked to fill out DS-5535

I intend to bring the original 1040 form for 2020 tax year, we did not request the tax return transcript yes (not sure if it's even available because of the backlog...) to the interview. Will this be enough ?

Yes, we talked, outside, and our brief convo helped subdue my anxiety a bit. Thank you! 

He kept my passport and he said he would investigate more about why I got turned away at the order, how many times I crossed, when was the longest time I stayed in the US. Not that I didn’t give him the wholesome truthfulness answers but he just need to check, and he will follow up with me only through email. 

As a video player rewinding in my mind over and over a thousand times, of the interview, I truly get the reasons why this experience is a nerve cracking hurdle to some people, including myself, even though I am genuinely throughout and our marriage is 1000% bona fide, the Consular Officer has to try reading your mind between the lines, with your 3/4 of your face covered by a mask, your voice got blocked by a sheet of flexi glass, setting in a public room that everyone can hear your love story. What upsetting thing is, this set of questions probably be asked to any body in the world, same category with us. But with you folks, Canadian- USA, for all the long distant relationship, we just hop over the border whenever we could to see your significant other. So naturally, you will have the I-94 longer than your job application form and you will get turned around one time at the least, during the dating period. Why asked? Why left us hanging on a thread? Why? and Why? and Why?

1040 and W-2 and/or 1099 I think is required in absence of the transcript. We are having to do the same as the IRS hasn't processed my husband's return yet (boo).

Echoing what everyone else is saying that the AP is likely due to the refused entry. It's generally resolved pretty quickly, but as you were not born in Canada yours might take longer than the usual <1 week. The fact that they kept your passport is a very good sign that they expect to issue your visa without too lengthy of a delay (if they expect AP to be extended they usually send you home with your passport and will contact you to send it in later). 

As for the police certificate, it's normal for them to keep it. They kept mine and mailed it back with my passport.
