Anyone have any insight on how long or what happens while in AP? How can I get updates or check in? The interviewer said all documents are in order and had everything he needs. Had to assume it has to do with my application withdraw or I just got a mean dude idk

A few months back some one on here had the same problem I think they said it was with in 2 weeks things were fixed.

This must be so nerve wracking. Since I had the same situation as you and had to withdraw due to lack of ties, I suppose that also awaits me. 😢 @Kai (CanadaDude) is on point, I am crossing my fingers for that that itll get resolved soon

Can someone clarify what application withdrawal is? If youre turned around at boarder/customs for lack of ties to canada...do you have to withdraw your application and start all over?

Application withdraw is an option given at the border when they find you inadmissible to enter. They give you the option to turn around on your own will

Essentially if a CBP officer determines that you are not eligible to enter the US as a nonimmigrant due to weak ties to your home country they usually offer you the opportunity to 'withdraw your application for admission'. This means that you effectively say "Okay, I understand I can't come in. I would like to go home instead". There's no inadmissibility triggered (or ban) when this happens, but if you are in possession of a non-immigrant visa it is cancelled. The impact of this on Canadians is pretty low given that they can try their chances again on another day by demonstrating stronger ties.

Those who need a B2 or ESTA to get into the country will need to get a new visa from a US diplomatic mission. ESTA is generally presumed to be lost for life when this happens.

You do have the option of not withdrawing your application for admission, but that generally would mean that you're forcing the CBP to in effect remove you, which triggers a 5 year inadmissibility bar as an "alien previously removed".

The impacts of withdrawal of application for admission is generally minimal on immigrant visa applications, but it must be declared on the DS-260 and/or during the interview. Failure to do so can be considered material misrepresentation and trigger lifetime inadmissibility.

Ah okay. I have B2 and im Canadian Citizen.

So if ever in this situation, just comply and agree to withdraw my application for admission (and this solely is just for the current admission im trying to enter US for right?)

Thanks!!

Out of curiosity, why do you have a B-2 visa if you're a Canadian Citizen? I thought Canadians were always exempt from needing a visa to enter the US as a tourist regardless of previous run-ins with immigration?

Unless you're referring to that you enter on B-2 status without needing a visa...cuz that part is the norm.

I know Canadians can get a B-2 if they really wanted to, but I thought there was generally no point to do so.

Also yes, I would add, never say no to CBP if they ask you to withdraw your application. Not doing so will all but sure to guarantee an expedited removal and the 5 year bar.

There is a wavier for IV applicants with the 5 year bar, I think it's an I-212 wavier for it. I-601 is for other grounds of inadmissibility if I recall such as unlawful presence.

Thanks so much!

This willl be my 4th visit within the past year. I always just saying im going to visit my wife. They ask how long I am staying. And then they send me on my way.

This trip (going this week) im bringing: travel insurance proof, proof of financial bank assets and accounts, proof of my return at the end of August. And then I have another roundtrip booked from November to January that I am also bringing proof of. Plus a copy of my car insurance (though i dont own the car). I might also have proof of a medical appointment in Canada for September. I hope if I ever get asked, this is sufficient for entry into US to see my wife.

I will definitely post how my entry goes.

This is from last year. I am guessing the backlog still exists: https://www.jdsupra.com/legalnews/uscis-discloses-delays-in-issuance-of-32189/

Nah.  Sometimes it'####### and miss.  Many people are getting them within days now.  This might be a funny case.

Hi everyone,

I have my Green card and crossed sometime last year. I received a 2 year instead of a 10 year green card. I filed the i-90 form last year and I got a letter in the mail (I-797C appointment notice) asking me to come in for biometrics..

Anyone familiar with this process? I called USCIS but, the agent seemed clueless. _ have 2 newborns and don't want to leave home (2 hours away) until absolutely necessary.

Thanks!

Have they actually issued a date for biometrics?  When we filed the I-90 for Kid2, I got a generic NOA saying we'd receive notice for biometrics.  We didn't have to do them once they realized what the I-90 was actually for.

Congratulations!! What questions were you asked by the officer? Have ours next week so we're curious lol.

If you go look up the reviews for the Montreal consulate, there are many.  Most have a list of the questions asked.

Congratulations!!! 😁

Over dinner I was telling my husband about your case and how you were put in AP probably due that "withdrawal" last December.  The thought of you on your way to visit your wife only to be turned around at the airport...our hearts went out to you. Couldn't imagine the anguish you felt. Glad the cruel process is over and you can finally be with your wife again... 😭  Happy tears....
