I submitted my AOS on May of last year and received my permission to travel on february. I have more than a year that I don't see my family and I am planning to travel next month to Colombia to see my mom. My husband cannot go with me because of his work and this trip would last 15 days. I wanted to know if this is safe to do and if any of you have travelled with the EAD, specially since all of what is going on with DACA recently.

 

My country of citizinship is Venezuela but I am going to Colombia because my mom has a tourist visa interview (there is no USA embassy in Venezuela) to visit me here in the US and I want to join her to give her company while in Colombia. My fear would be that in the way back they would not allow me to enter to the country.

EAD has nothing to do with travel. If you have AP or applied for it, you can travel.

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

Moved from K1 P&P to Working and Traveling during US immigration- OP is past K1 and doing AOS 

 

Is the EAD a combo card together with Advanced Parole (AP)? Did you apply for I-131  (AP) when submitting AOS

My mistake, I meant Advance Parole. Thank you! I have heard that travelling with the AP without your american partner can be risky and have been told by many people to not do so

I just edited my post as I meant Advance Parole. While submitting the AOS I applied for AP and I already have it. I just have not heard anyone who has left the country with it and I am a bit afraid it will cause me trouble.

I have not heard of anyone being denied entry in this particular situation (AP during AOS from K1). Make sure you carry a certified copy of your marriage certificate in case they ask upon your return.

The only reason AP is issued is so one can travel abroad and come back. Why would it cause trouble. You will face the similar trouble you faced when you travelled to the US on your K1 visa.

That is good news!

 

Do you know by any chance for how much time one can travel with the AP?

I don't believe that there is technically a time limit but obviously you don't want to be gone so long that it looks like you've lost interest in getting your green card and living permanently in the USA. You also want to make sure you're back for your AOS interview. It's probably not going to happen soon, but you also never know.

Definitely! My husband and I went back to visit his family when he had his AP card. There was an extra step when we returned at the airport in the US. We had to go to a second room for processing (similar to how we had to when he came with the K1). Of course with our luck, our AOS interview was scheduled during the time we were in his country. But we were able to contact them and move it to about a month later. Enjoy your trip home!

What is the risk?  Sounds like more inaccurate advice from FB.  I would ignore any more advice these people give regarding immigration matters.  You can expect to go to secondary inspection when you return.....which is not uncommon.  My wife even had a secondary inspection with a CR-1.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I agree with everyone that traveling on your AP should not be a problem, and it's a good idea for you to bring along a copy of your marriage certificate and a photocopy of your husband's US passport. And do expect to have to go to 'secondary' when you return which may sound worrisome but is very normal for people on AP so just allow for the 15-30 minutes this may take when re-entering the US, in case you have a connecting flight.

My wife when she got her AP/EAD combo card used it to leave the country 3 times in a 4 month period. By land, sea, and air at different ports of entry every time. When we flew back thru Seattle, WA, she actual beat me thru the CBP inspection point with her AP as I have Global entry so I went thru the " Fast Lane", but by the time I got thru she was waiting for me looking at me like I was holding things up LOL. Use the AP, thats why you applied for it. And you can stay outside the US for up to a year technically without abandoning your residency, but I wouldn't push the limits, to stay safe I would say no more than 6 months to be extra safe. Flights get canceled, things happen ( Think Covid), and you don't want to be trying to get back before you hit 365 days.

This sounds good, I actually want to travel to my home country but am scared too. Am divorced and my 360 was approved last year August. Still waiting for AOS interview.
