Sample letter to NVC (merged)

Hello,

 

I was recently asked to submit I-864A for my spouse who is the intended immigrant (but currently lives with me and we filled taxes jointly). 

When i had filled out my I-864 form we were at a different address but now our address has changed and i had called NVC to report the change of address couple of months ago.

My question is: Should i put the new address in the i-864A FOrm for him? or just use the old address to avoid any confusion of them thinking why don't we live together or something? 
Please let me know what you guys can recommend.

Hello,

 

Can someone please help me with a sample letter to NVC, They have recently requested my spouse(beneficiary) to submit a I-864 A but i called NVC and they said if i do not want to list him as household i could just submit a letter stating so and attach it in the aditional documents section, that way they wouldn't expect it.

Please let me know if someone has written a letter to them before that was accepted i would greatly appreciate it.

Yes I am the petitioner. nVC asked to list my husband (beneficiary) as the household member and submit I-864A for him. Because apparently I said I will be using his income on my I864 form. We reside together and file taxes jointly so I thought I had to list him.

If you want to include your husbands income, you can do so on your i864, i864A is not required. He needs to submit his paystubs and a letter from his employer mentioning his employment will continue after he becomes an LPR.

so I did put him on my I-864 which is why they are now asking me to list him under household member as well and for me to list him I have to submit the I-864A. 
honestly I don’t really want to put his income if I don’t have to. I just wasn’t sure before. 
But I did contact NVC and they said just don’t if u don’t want to. But write a letter stating that I no longer want to use his income. 
 

I shouldn’t have listed his income to start with on my I-864.

NVC said since I am the sponsor. I could just use my own income Only. 
the only reason why NVc asked me to put him under household is because on my I-864. I put joint income instead of just mine. So they expect all the docs for him too. 
 

so that’s the situation and they said all you need to do is tell them u didn’t mean to put him under income and u would just use your own income only.

If you are pursuing a visa for your spouse, how is he living with you in the US?  What visa did he use to enter?

 

Also, what is the source of your spouse's income?  Is your spouse authorized to work in the US?

 

An I-864A is not required from a beneficiary, unless the beneficiary has children who are also immigrating.

 

Can you post the exact text of the review note on CEAC from NVC?

My spouse is on TN Visa he’s a Canadian citizen. He is authorized to work in the USA. 
I am applying for him to get his green card, we got married 2 years ago. 
 

Exact text: . Please add (Beneficiary’s name) as a Household Member under  (petitioner). All documents for (Beneficiary) should be submitted under their own name

So where does it ask for i864A? 
 

Two options:

1. Fill out new i864 with including your husbands income. I864A is NOT required, you just need to enter his info on Part 6, Person 1 box. You need to include his paystubs and most important a letter from his employer mentioning his employment will continue after he becomes an LPR. It won't be approved without that letter from the employer.

 

2. Fill out new i864 excluding your husbands income if your income is sufficient for sponsorship.

Thanks for the additional info.  Even with that note, an I-864A is still not required, if you want to include your spouse's income on the I-864.  From page 8 of the I-864 instructions -- https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf

 

"If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part 5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status. He or she does not need to complete Form I-864A unless he or she has accompanying children."

 

Instead of an I-864A, upload a note with that excerpt from the I-864 instructions.  Just make sure you also upload evidence that your spouse's income will continue from the current source after obtaining LPR status.

Okay this makese sense, BUT when i called NVC customer service, they said i could just write a letter that i do not want to include his income and attach it in the documents.

Do you still think i should fill out a new I864 to be safe?

I didn't understand your question. I thought you didn't want to list your husband as a household member. That's what confused me. I think I understand, now. If you were to fill out your timeline, it would help us to help you.
