I-130 and Proof of Marriage

Hi everyone,

 

I need some help from y'all.

 

I'm a permeant resident and I'm in the process of completing online I-130 for my new married wife. My wife lives in China. We've known each other since almost 8 years ago. In 2017, we started getting closer and have been in relationship since earlier 2019. I went to China and stayed with her for couple weeks  in October 2019. Then as everyone knows, covid started outbreaking all over the world and I can't go to china to see her at all.

 

Last month, thanks god, finally I bought a ticket to China and married her (1st July). However, I didn't stay very long (about 2 month). I have not choice but flied back to the U.S by myself. 

 

Now, according to the online I-130 instruction and some lawyers, I need to upload some material as proof of the marriage.,

such as  

Property we share,

Insurance statement with both our name

Joint bank statement 

Joint mortgage statement

etc...

 

me and my wife got married only 1 month and now we are apart in two different country. We don't have any joint account as the USCIS expected. How can I prove our marriage is real?

I do have below:

1) Official Marriage Cert (Translated in English)

2) Daily Photo me and my wife in the same picture.  Taken when i was in China back to 2019

3) Daily photo : me and my wife in the same picture. Taken when i was in China last month (July 2021)  

4) me, my wife and my parents in the same picture

5) Copy of Leave Application approved by my wife's employer. The reason of leave is Marriage Leave.

6) The hotel itinerary shows both of our name.

 

I really don't know what else material I can provide to prove the marriage. Will USCIS deny my I-130 Case?

PLEASE HELP ME

For me you have good evidences. The best proof to start is the Marriage Certificate.
 

I had less then you and was approved haha so don’t panic too much.

 

You have more or less 1 and 1/2 years until the interview. Enough time to have more things together (trips, etc).

That's great evidence when the petitioner's parents attend the wedding. I presume the Chinese spouse's parents were also there.

Unfortunately,  we haven't had our wedding yet. I had very limited time stay with my wife when i was in China. (we stayed together about 4 weeks after the quarantine, then i flied back to the U.S. )

 

Our plan is to have our wedding next year some time. 

 

We had a pre wedding photo tho. and a photo of me, my wife and my parents together after my mother's birther party

 

Will those help?

We got approved with much less as Paula has also said before. If necessary, additional evidence can also be brought to the interview.

They will approve the I - 130 first then let my wife to go to the interview? If that's the case then i have more confidence to submit the form :)

No. After the I-130 is approved her case will me sent to dr NVC (National Visa Center). There you will need to send more documents, pay fee, complete de DS-260 etc.

 

After all this is approved by be NVC they will send the case to de Consulate. They will send her the information about when she can do the medical exams and when will be her Interview… 

 

a lot of steps but be patient and use all the time you can you read the instructions on the USCIS page and here too. A lot of good information here!!

You mean your wedding party, right?  Or "renewal of vows" ceremony, maybe.  You can't file the I-130 if you're not married.

Hi Chancy,

 

We are married, we've got our marriage certification from the local department but had no time to have the "party" wedding yet

Thanks for the clarification.  That's fine for filing the I-130.  There's no requirement for a wedding party.
