You are encouraging OP to lie in the new petition by not disclosing the record he has after getting it sealed.

If OP decides to move forward with a CR-1, first get married then file an I-130 petition, just know that because of the previous misrepresentation on the I-129F, the I-130 could also be denied as a consequence.  Not sure how a possible waiver for the misrepresentation could be sought, as typically this happens at the visa interview when the misrepresentation is on the beneficiary side and interviewing officers have discretion related to a waiver for misrepresentation.  This case will hinge on the petition approval at USCIS and waivers at that stage may or may not be possible, hence the need for a good attorney if there is any hope to overcome this problem.  Good luck OP!

It's obvious from your posts that nothing will change your mind about that convenient fantasy.  But we know of actual cases of VJ members where expunged records were uncovered by immigration officials without need for court order.  This is also not the first case we know of that was denied due to non-disclosure of a record that was later uncovered.

 

You are free to believe what you want to believe, but advising others, even indirectly, to lie on an immigration form by not disclosing an expunged record is against VJ's Terms of Service.
