Birth certificate issue

I’m from India and my spouse has filed petition for me. We are about to get NVC welcome letter.
1)My birth certificate does not include my last name and registration is 8 years late.

 

2)I was born in 1992 and birth registration was done in 2002.

 

Will these create issues at NVC?

This is 10 years late not 8 years late.  Which is it?

 

Now is the time for you to be consistent in how you explain your case.

Yes you can expect an RFE.  
 

Try to correct the birth certificate or try to get a legal change of name document.  
 

Get affidavits from the parents attesting to the truth of the beneficiary being born as per  the date, place, and parentage claimed by the birth certificate.  Also attest as to why the birth registration was 10 years late.

Thank you!! And yes it’s 10 years, my bad. I’ll try to get last name added if possible and include the reason for late registration.

Your parents would need to attest to the reason.

Yes, I'll submit the 2 affidavits from each parent. Can I submit the affidavit that my name and my name including the last name are both mine, in case I'm unable to get a correction?

Late registration is late regardless of the reason, so providing the reason from parents will be of no use. Try to get corrected birth certificate with last name added if possible, if not still ok.

 

Get Affidavits of Birth from your both parents, you can google for samples. If you have any other documents like school certificates or hospital records and such that list your name, DOB, and parents name, use that as well.

From what I have seen, if the name on you birth certificate differs from that of your passport, you will need a legal change of name document issued by a government  entity with legal authority over changes of name.
