Is it legal ??

Hi there,

 

So I am currently waiting for my EAD (AOS). I have my bio next week and my plan is to start looking for a job as soon as I have my bio and then ask USCIS to expedite my EAD with a job offer. but i wonder: is it legal to look for a job even if i don't have my EAD yet? (I am of course NOT looking to work without a permit but I'm trying to understand if it's possible to start searching)

 

Because I see a lot of people saying ''I expedited it with a job offer'', but if you have a job offer it means that you were looking for a job without having the EAD... so yeah, can i get in trouble if I do this or is to allowed?

Yes. It is legal to look for a job before EAD

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

It's not illegal to apply/look for jobs while waiting for EAD...and why exactly would it be?? USCIS would not offer expedites based off on job offers if it was illegal to look for a job while waiting for EAD. It's only illegal to WORK without the EAD or GC.

@Marion Defoyer, yes, as others mentioned it is legal. It is against the law for a potential employer to ask you to show proof of employment authorization. All they may ask is "will you now or in the future require sponsorship for employment authorization?" You will respond no to that question. And that is true. You will not need to be sponsored. 

You will only show documents to fill out the I-9 on your first day of work. You actually have 72 hours to produce them. The clock starts on your first day of work for pay.

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
