Bio & Interview Waived?

 Share

Hello,

I have been following the googlesheets tracker and I note that some people are getting waived for biometrics & interviews. What are the reasons for this, are there any or is it assessed on case by case basis?

What are my chances of being waived? few details about me;

Entered 2019 on K1, still happily married

Similar age and financial standing to my wife (if this makes any difference?)

Strong evidence of comingling, shared bank accounts & assets

Interviewed together as part of the AOS process

Biometrics taken as part of the AOS process

No children

The interview office is 6hours from me and I am hoping I don't have to make that trip again!

I would say good. Mine was waived. The Pluses are, You've been interviewed before and you have some good evidence of comingling. Of course every case is different so its not set in stone and they might do a random interview but I would say based on my experience your chances are excellent for no interview,

Since you had AOS interview, it's unlikely you'll have to do ROC interview. Most AOS interviewees are having their ROC interviews waived so long as their evidence is good. Note that this is not 100%. It's still on a case-by-case basis ultimately. It does make sense for them to not interview couples they have already interviewed only 2-ish years ago (and also, COVID's still around). It seems like most people who are waiting for an ROC interview are those who entered the USA via spousal visa. For spousal visas, the initial interview is done abroad in embassies and consulates, which are not under USCIS. So it would make sense for USCIS to want to do ROC interviews for those cases, but again, this is just the generalized average pattern we're seeing right now. It is not 100% across the board and it never will be because if they suspect an AOS case to be suspicious or weak on evidence, they will call the couple for an ROC interview. As for biometrics, I think you'll probably have them waived but that's not guaranteed either.

@Reed1812 I just wanted to add to the information others provided. Sometimes they call picture perfect submissions just to do quality assurance. This article explains it nicely;. https://citizenpath.com/avoiding-i-751-interview/

They assign fraud levels ABC and will call for interview everyone from the highest fraud level, some from the medium and some from the zero fraud level.

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken.

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

If the biometrics were waived, how would the USCIS let me know this? Would it be a letter, or just an update on the case status site?

Both. At least that's what I got. An update on the case status site and a week later a later stating the same.
