Utilities- note from the landlord

Hi everyone,

I have to apply for my ROC in January 2022 and I’m already collecting the evidence (well, I never stopped collecting it lol!). We are sending our two leases. In our lease it says that tenants are to pay for utilities, but our landlord does it. So, we won’t have much utility bills from May 2018- August 2021 (we’re moving out now and we’ll pay our own utilities). So I made a note for our landlord to sign explaining this. I could really use some input on the note itself! I’m not really worried about the rest of the evidence because we have plenty:

 

health insurance

car insurance

home Insurance

mortgage and home title with both our names 

joint bank account

plane tickets

Tax returns 

vet bills

utilities

DL showing same address

State taxes

pictures

 

I’d really appreciate some input over the landlord’s note.

Also, I am aware that I need to send evidence from the time our marriage started till the moment we submit (and keep collecting it in case our ROC takes a long time).

1. When are you moving out? If it is within a month and you have already secured the new address, I will file ROC with new address and can get the PO to hold mail for new address till you are physically there. I say this because USCIS and AR-11 are like water and oil.
2. I think you have enough. I would not worry myself with the utilities. I (immigrant) pays utilities and they are all under my name. I have never submitted any utilities to USCIS. I never had issues. I am oathing on Aug 14th. I passed my N400 interview 7/15.

We’re moving out this weekend, so since my ROC window opens in January I will for sure file with the new address. I have already signed up for usps forwarding, and I will file AR-11 once we are settled in (probably early next week)

I’m a planner! Plus I am on vacation and I’ll get busy really soon, so I’m just trying to get things done as I go.

@ra0010I think the note looks good. You have really good evidence. Hopefully, processing times have improved by the time you file. Potomac just updated - 20 to 139.5 months. LOL

Thank you! I don’t know if it’s because I’m being positive or what, but I think that a lot of times they put those processing times to have some slack, but lately I’ve seen ROCs approved in 7 months. Our AOS was approved in 6 months, interview waived and everything, so we might get lucky this time too in terms of processing. By the way, does the timing for ROC vary according to the State?

OP - you have SO MUCH evidence (and more significant one as well). I wouldn't even bother including this note, honestly.

 

When I filed for ROC - I barely included anything lol Just the absolute bare minimum as I hate wasting paper and got approved without an interview. If you were called for an interview during your AOS and had no issues - I wouldn't stress about it.

I agree with you. I think they did that to prevent everyone from sending a case inquiry. Of course, officers have to respond to those case inquiries and that takes time away from adjudicating pending petitions. Every processing center has its own pace. Every now and then some officer grabs cases from the wrong pile and approves recently filed cases while there are still much older files pending.

Hi there! Thank you for your comment. We didn’t have an AOS Interview because ours was scheduled right when COVID hit, so they called us and they told us they’d cancel it. Then, about two weeks later they sent us a letter from the FO asking us to mail them the evidence we were going to share at our interview. So we mailed two binders full of evidence, plus our wedding album and another album with regular, everyday pictures. And then we were approved about two weeks later.

Doesn't sound like you have any red flags or any issues so even though you didn't get the interview during AOS - I wouldn't be surprised if your ROC was approved without one as well

Absolutely. I didn't see any recent ROCs being approved quickly (but of course I'm not tracking the timelines 24/7 so there definitely might be quick approvals out there) but in any event - you should be able to file for your naturalization about one year after you file for ROC, and N400s have been being processed quicker than I751s.

Oh I hope so! I have only seen one person having both interviews waived, but who knows? I mean I don’t care because our marriage is legit, but statistically wise I haven’t seen many cases were both interviews were waived.

Here is another thought. It all depends upon how USCIS looks at your AOS interview. While you did not attend an in person interview, you still submitted evidence that you would have had to submit during an in person interview. When they waive interviews, usually they adjudicate the petition with the information submitted initially with the petition or later on with an RFE. That is all to say that I think there is a good chance that they'll just approve it without an interview.

It would be interesting to know how that works. I’m also not from a high- fraud country, so maybe that helps because I’m pretty sure they look at the totality of circumstances.
