aos mariage based interview

It says the interview was completed and will be reviewed, so you will have to wait for their decision. Why did you have a stokes interview? Any red flags?

USCIS typically gives the petitioner one more chance to provide documentation/proof before denial.

Someone told us they usually approve the case on the spot, therefore it is just going to be a denial. We are so worried and my wife is beside herself. Does anyone has any idea on how long that might take to see the status changes ? Please help.

Whoever told you this is wrong. Sometimes the IO are new, and they need to share the case with a supervisor, which can take time. But like I said, in order to help you better, we need more details. All we know is that your AOS is marriage based, that you had a stokes interview, no response after, and your wife is sick with worry. However, none of those details help us. I think you know the red flags that your case might have. Also, what sort of questions did they ask you, and did your answers match?
Also, it’s completely useless to ask about how long status changes take. For some it takes hours, for some days, weeks, or months.

2 hours . Ouch.  Ours lasted maybe 3 minutes each, basically 3 questions,  how many dogs we have, who smokes and what languages we speak.     I think the interview was because the officer of the initial interview left, and the file sat for so long, documents were missing, they even issued a NOID which I myself addressed quickly.  But even after all that, took then a bit to approve it, but Houston is know for being slow as snails.     We did have Red flags,  age, religion, divorce,  and I filed for once before long time ago.  Enough red flags, but overcame them all.  Hang in there, all you can do is wait it out, worrying will not help.    Wishing the best for your both.  And remember, no two cases are the same,   so don't expect your case to turn out like someone else's.

I had my interview yesterday; it was a stoke interview. They questioned My wife first. IO questioned me for over 2 hours. At the end of the interview, she told me I would receive the decision in the mail.. However, I noticed this. Please can someone explain this to me? Does that my case was denied? Please help

"Your interview for your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number MSCXXXXXXXXXX was completed, and your case must be reviewed. We will mail you a notice if we make a decision or take further action"

@jacko paul It sounds like it was a rough interview. Are you sure it was a stokes interview, though? Stokes interviews are always 2nd interviews. To me, it sounds like the officer interviewed your wife first and then, the officer interviewed you. That is actually how my AOS Interview was. The officer interviewed me first, then asked me to send my husband in. I was with the officer for maybe 30 to 40 minutes. He asked me 5 general relationship questions. The majority of the interview was mostly going through the forms and verifying the information that we had submitted.

He told us the same - your case must be reviewed and you may hear from us within 120 days. However, we got approved the next day.

Questions for you:

  1. Did you adjust from K-1?
  2. if you did not adjust from k-1:
    • Did you submit sufficient evidence of bona fide marriage with your petition?
    • Or did you only submit the marriage certificate and planned on bringing the evidence to the interview?

@USC4SPOUSE Just curious to know why you asked whether the OP was adjusting from K1. Is it because the folks adjusting from K1 to GC will not be made to go through separate interviews?

It’s less likely because the relationship was vetted already at the consulate when getting the K1 visa. Few years back, a lot of K1 AOSers didn’t even have to have an interview, this was reversed unfortunately. Good old days.

@NBVH Glad to clarify. Typically, when you adjust from K-1, you really only need to send the marriage certificate as evidence of bona fide marriage. USCIS used to waive interviews for folks adjusting from k-1. While that has changed in the last 2 maybe 3 years, USCIS does not expect much more than the marriage certificate from k-1 AOS applicants.

Now, if you are adjusting from other visas and you only send the marriage certificate, that can create problems. Often times, the officer will already suspect fraud before the interview even starts.

So that's where my question was coming from.

What happens often as well is that folks adjusting from other visas submit evidence since the date of the marriage. So it looks like they met on Monday, married on Wednesday and filed for AOS on Friday. Thus, they do not send any evidence of the relationship or even knowing each other prior to getting married.

I am also almost certain that OP did not have a Stokes interview. Those are always 2nd interviews and almost always there is a camera recording the whole thing. In his case, the officer interviewed the wife first and then, interviewed him. That is what many Field Offices do. That is not a Stokes interview.

Yes, exactly. All they had to show was the marriage certificate and the green card would arrive by mail.

I do not know, because that was my first interview,  but the only think I can think of is I  was married to an LPR about 20 years ago back in my country, She petitioned for me and they denied the visa.

Thanks

You are right; It was a rough interview as it was our first interview. My friend told me it was a stokes interview. You are totally right the officer interviewed my wife first and then, the officer interview me for maybe 120 minutes. She asked me questions about my ex wife, my relationship with current wife then went over the forms and asked me to verify the information. She told me I would receive the decision letter in the mail. However, when checking my USCIS account the same day, it says "case must be reviewed.

-Yes, I submitted evidence with the petition, but I did not submit my medical, I brought it to the interview with me. We have been married for 3 years.

Thanks, I do appreciate your input as I am really worried.

What questions did they ask you and your wife about the relationship? Were your answers similar?

We did not have all similar questions, as her interview lasted about 30 minutes and mine way longer. I can not remember all the questions, but see below the ones I remember

  • Where did we meet?
  • What did the two of us have in common?
  • Where was my first date?
  • What did we have for dinner, lunch yesterday??
  • What is my wife's favorite color?
  • Have you met each other’s family?
  • How do you typically celebrate holidays such as Thanksgiving and Christmas?
  • How many brothers and sisters does your spouse have? What are their names?
  • Does your spouse have any nieces or nephews?
  • Do we have mutual friends?
  • What’s my spouse’s best friend’s name?
  • Do we have any children from previous marriages?
  • Do you live together? Where?
  • Where have I lived before?
  • When is my spouse’s birthday?
  • Have we ever been on vacation together?
  • Do I attend church?
  • Does my wife attend church
  • How much I pay for rent?
  • Do utilities include in my rent
  • Who do we rent from?
