Hello All,

 

My mother who is Permanent Resident of USA was filed I130 for me in September,2019. I am 30 years old and unmarried. California center. Receipt number is starting with IOEXXXXXXXXXX.

 

I saw the update on my case that " case is being actively reviewed by USCIS". What is this status means ? Will I get decision soon ?

That’s the standard status for a case under review. F2B for India currently only has visas available for cases filed before 22 Sept 2015 (see table A here https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2021/visa-bulletin-for-august-2021.html ) unfortunately you still have some years to wait before a visa will be available for you.

I'm surprised to see that it takes longer for the unmarried child of a citizen to enter than the unmarried child of a permanent resident.

It seems that as soon as someone gets a green card, they can apply for their unmarried child instead of waiting 5 years for to become a citizen and then applying for the unmarried child.

It didn’t always used to be but it depends on the interplay of how long the queue is vs the annual quota per category. 

 

Yes, there is absolutely no reason to wait until becoming a citizen provided the son or daughter in question is unmarried and remains so.

Yup, it's based on supply and demand for each category. There're different visa numbers allocated for different categories. There is too much demand in the F1 category than the F2B category that's why F2B seems faster right now. Of course, this can change anytime.

No need to wait as a permanent resident to petition your child. In fact, one subtle advantage with F2B category is that when the petitioner naturalizes you can choose to upgrade your category to F1 or maintain F2B based on which line is moving faster.

Yes, all the F- categories including F1 and F2B allow derivatives.  The derivatives have to also do the same process (medicals, interview, submit docs and pay fees) and will get immigrant visas with their parents. The actual green card you only get once you have used your immigrant visa to enter the US.

In general, years not days. There is no further update unless either they send a request for further evidence (RFE), which should not be needed if all appropriate documents have been submitted, or until the case is approved. At California service center the processing time (time to approval) for F2B is 53.5-69.5 months (cases currently only considered outside normal processing time if filed before 19 Oct 2015 and not completed yet). https://egov.uscis.gov/processing-times/ 
There is no reason to rush processing because a visa cannot be issued before the priority date is current anyway. 
Nothing of consequence is going to happen on your case for a few years.

Thank you for the answer. My question specifically only for the I130 approval. Many in the Visa Journey received an approval of I130 with in couple of day after they see the status "case is actively being reviewed". and many see the approval notice on their USCIS account but the case status on the website still showing "case is actively being reviewed".

Hello All,

 

Last week,  I submitted address change request AR-11 form for my F2B I130 application and today I got email from Vermont  USCIS Service Center. 

 

When I submitted I130 my application, It was is California Service Center. I have NOA1 from California Service Center for F2B I130. Since I got address change request AR11 approval email from Vermont Service Center, Does it mean my F2B I130 case transferred to Vermont Service Center ? 

 

I did not get any communication/mail from USCIS about my case transfer. I believe USCIS generally sends mail/update status whenever Case is transferred to other service center.
