Hello-

 

My husband applied for 485 based on marriage to me. We received what looks a letter from selective service. He hasn't had biometrics yet and his 485 is still pending. We received a letter and not sure of it's legit.

 

ANyone lese receive this a few months after NOA 1?

Please read page 6 of the I-485 instructions.  It has a section about sending the applicant's information to SSS, if the applicant is a male between 18-25 yrs old.

According to the OP, AOS is still pending therefore her spouse is here on a non-immigrant visa and therefore not required to register for SS. 

 

Worth a call to the number on the letter to confirm. Googling shows that the number given within the letter is the correct phone number. Good luck

Don't even need to call.   Registration can be verified online.

Likely legit.  He agreed to this when he signed his I-485 which says:

 

I understand that if I am a male who is 18 to 26 years of age, submitting this application will automatically register me with the Selective Service System as required by the Military Selective Service Act.

 

As many folks on VJ like to tell me, aliens with a pending I-485 technically have no status.  It turns out that every male 18-26 in the USA who does not have a non immigrant status must register.  
 

 This includes illegal aliens and LPRs.  Well apparently it also includes those who don’t “have a status”. Cuz if you don’t have a status then you don’t have a non immigrant status.  Or an LPR status. Or an illegal immigrant status.  

 

If he has a social security number he can verify the registration online at sss.gov.  
 

Take steps now to secure this document from SSS so that when he applies for citizenship  he has it.  
 

When he gets an SSN he should contact SSS to get his SSS record tied to his SSN.  
 

As someone who failed to register and INS failed to register me, suffice to say, your husband should be pleased to be registered.  His naturalization process will be smoother and he will be eligible for federal service.

When we AOS from K1 and K2's, my son was only 15 at the time. USCIS registered him automatically even though he was only 15 and before we got our AOS approval. They do it and do it often, so I do not believer it is a scam either. His was never connected to a SSN as he couldn't get one until the EAD would have been approved. Since no SSN was connected to the SSC we could not search online for it when he lost his card. He had to call to get a new one. Do not lose that card your husband will need it.

It does not matter if he has a SSN or not.  USCIS automatically sent his information to SSS when you submitted the I-485, and he is within the age range of those required to register.

 

Keep the card in a safe place because until he gets a SSN, he will have a difficult time providing proof of registering with SSS other than that card.
