Parents (IR5) traveling from China to the US

Hi, my parents recently received their IR-5 visas through the US Embassy in China. Are they currently allowed to travel to US with the 14 day restrictions for those that have been in China?

Also, I am NOT under 21. As this is noted an exception in the Presidential Proclamation.

Yes because they have Immigrant Visas: https://travel.state.gov/content/travel/en/News/visas-news/updates-to-national-interest-exceptions-for-regional-covid-proclamations.html "On April 8, 2021, the Secretary of State determined that travel on an immigrant or fiancé(e) visa is in the national interest for purposes of granting exceptions under the geographic COVID proclamations. Immigrant Visa processing posts may now grant immigrant and fiancé(e) visas to applicants otherwise eligible, notwithstanding these proclamations."

Hi! My parents just received IR-5 visa. They are in China. Can they come to America directly from China without staying in the 3rd country for 14 days?

Yes they can travel directly to the US.

Thanks! I called multiple airlines and they read me their allowed visa list and told me they can't tell me for sure until the day my parents need to board.

The airport/airline should read the info on Timatic which clearly says "passengers with documents issued by the U.S. Department of Homeland Security, U.S. Customs and Border Protection, or U.S. Department of State indicating that the passenger is exempt from the restriction;" https://www.iatatravelcentre.com/world.php

These three categories of travelers are automatically considered for National Interest Exception (NIE) at the Port of Entry and do not require advance approval of a NIE from an embassy or consulate.

• immigrants of all categories (not applicable to Proclamation 10199, which only covers nonimmigrant travel);
• fiancé(e)s of U.S. citizens and their dependents (K visas);
• Students (F and M visas) as described here;
• New or returning students present in China, Brazil, Iran, South Africa, or India may arrive  no earlier than 30 days before the start of an academic program beginning August 1, 2021 or after, including optional practical training (OPT);

I edited my recent post. The NIE is automatic in their case.

@al.vin and @Dianexing I suggest they fly with China Southern: "I was able to rebook him with China Southern and he is on the plane now!"

 

Turkish Airlines is known to have issues per the above referenced thread.

It doesn’t need to say NIE on the visa. The extracts we both quoted you (one above and mine in the other thread you started)  state clearly that immigrant visas automatically get NIEs.

They made it here without issue. They flew from China to Qatar to the US directly - without having to wait 14 days.
