We have hear from other AOS filers that we don't need a I-693 report of medical examination.  I do read on here to get a surgeon general to transfer medical info to a I-693

 

There is so many conflicting lists of requirements out there.. Example is to  just look on this website and the main AOS pinned topic is so old and flawed it should be deleted.

We have her SS card.. that took about 18 days to get.  Her K1 is good until July 31 We hope to file before then. 

 

Any help or corrections would be apricated.

Oh I was going to turn in an I-134 but I guess that is not needed?

Even if you dont file within the K1 90 day validity, it's perfectly fine.  My wife and I filed 3 months after the K1 expired, no effect.  

 

Your proof and form look good.  We did not have to redo a medical form.

 

Provide as much proof as possible to show a bona fide marriage (rental lease, deed, bills in both names, joint bank accounts, etc.) Best of luck!

Proof  of marriage?? 

We don't have a bank acct yet?  I did add her to one utility bill but the dual names are to long to be shown in a meaningful manner on the bill?   What deed?  House is mine and clear.

Your documents are correct. Proof of relationship sometimes they ask at the interview level. Like joint bank accounts of you can add her name in your lease or house deed etc. But initially you are good.. most of K1  people cant get any of it like bank account driver license, your wife us lucky that she got SSN.  Add your birth certificate to prove your citizenship

The medical examination did not reveal a Class A medical condition; or

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions. [27]

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application. [28]

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician.

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If the applicant was granted a change of status to V in the United States, [29] the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted."

If you complied with the above and filed AOS within one year of your overseas medical exam date, the I693 and its procedures/policies do not apply to you as a K1 applicant. It does not matter when your AOS interview happens, as long as you filed AOS within one year of the overseas medical exam date (and you meet the above conditions), your medical will never expire.
Submit a photocopy of your personal copy of the DS3025 Vaccination Record with I485 and bring your personal copy to the AOS interview as back up.
Your actual overseas medical exam documents were collected at your POE as they were IN your sealed K1 Visa packet and will be sent from CBP to DHS for storage in your A-file.
Your interviewing officer will collect your A-file for review at your AOS interview or shortly after and confirm that your previously submitted K1 medical exam and vaccinations meet the requirements.

So the two big questions are:

1. Is your DS3025 marked complete? Check the bottom left corner for the checkbox that says "K1 Visa applicant voluntarily completed vaccination requirements"

2. Will USCIS receive and issue you a receipt number within one year of your overseas medical date to have complied with the one year submission requirement?

If yes, you have completed the medical requirements to adjust status.

US Birth Certificate. And make sure to bring it and a photo copy to the interview.  Some IOs are ok with just a passport and some are not. And some won’t ask.

If money and time are an issue (and you have a July 31 deadline) then delay the I-693 until you get an RFE. if there is an RFE will most likely say you will need I-693 and to bring it to the interview.  Now whether not including I-693 increases the odds of being required to have an interview is anyone’s guess.  
 

We got the I-693 (our lawyer told us too) and the IO was irritated saying we didn’t need it.  
 

I didn’t care about the wasted money.  I do know that my wife needed more vaccines so I am not sure the IO was correct.

I disagree vehemently with the advice you are getting that it is ok to file after her I-94 authorized stay expires.  
 

It is not “perfectly fine” to file late.  At best it is imperfectly fine.  At worst it leads to deportation and a permanent ban as improbable as that might be.

The I-134, if it was needed at all, was needed at the actual K-1 interview.

I do have my USA birth certificate

We will open a joint account today.  

I'm still a bit confused on showing a true marriage.. Pictures of our bike rides together?  our flower or veggie garden? Cooking together?

I don't see why I need to add her to the utility bills and not going to be adding her on my house deed for at least 10-15 years if ever.. that is for the will.

 

I'm a  bit confused on Page 4 of I-864

It asks for total dependents.

1 from part 3 item # 29 which is beneficiary

1 is for yourself

Then 1 if your currently married

Seems like they count the beneficiary 2 times as this total is 3.But for some reason a number 

1 is already locked in part 5 item # 8" household size" and I cant change it. 

Seems like it should be 2?  do I just white it out and put 2?  Why do so many places on this form  not allow electronic input?

Oh I was going to turn in an I-134 but I guess that is not needed? 

Treat every form as a separate application. Read the instructions for each form and gather the required documents for each one individually. Like passport photos, you need 2 for each form (484,131-765), copy of your passport, 1 for each form, if last name changed, marriage certificate for EAD and AP as well...

 

You said Tax record. Make sure you're getting either the Tax RETURN transcript or the whole 1040 return with all the schedule, +W2.

 

I don't know what transcribed into English medical report means. Your medical forms should already be in English and they were inside the envelope you handed over at POE. So no need to that in the package.

 

No need for a 693 if you're filing for AOS within 1 year of the date of the medical.

 

Are you using your 401k account because you don't have enough income to support the immigrant? Don't know how it works for 401k accounts, but for regular accounts they ask for 1 year os statements, I would send that as well just in case.

Everyone counted from question 2-7 are people not being sponsored by the affidavit, so you can't count your spouse there. The answer for 3 is 0.

 

Save the marriage proof for the interview. The only proof needed for the package is the marriage certificate.

The IO was correct. The vaccines need to be current at time of the medical. If waivers were given by the doctor (not available or not in season), the IO is supposed to waive these vaccines for AOS as well.

On the top you will see: Don't count someone twice, and then before question 2: people not being sponsored. So yes, the answer is 0 to question 3.

The form automatically adds up 1-7 when filled out on Adobe Reader. If you use another app to fill out the form, it will stay at 1.

Hello OP,

first, read the instructions for each form carefully. Also, my advice is that you do drafts of the forms before you send them. 
Our AOS interview was waived after we sent the following evidence. Feel free to use it as a guide!

you sent in proof of marriage?  I didn't think this was needed?  Ae you saying a lawyer told you to do this due to covid and maybe your interview would be cancelled? . 

Thanks all for you help. I am rereading all the instructions carefully.  of course I print out an d recheck everything. I swear my form wont add up the numbers and had a 1 struck in the total from when I first open in from the government site.  Maybe my laptop isn't using the acrobat reader that's installed or using a copy or something but to me it looks like I am viewing it on a URL right from the government site.  

I did read in the instructions that if you met the income requirements last year you don't need to put assets but I think in my case it is best I do as I am using this IRA to supplement my income from rental activities when needed.

We did open a joint account which I guess may help at the interview.  I did add her to one utility bill but the display line cuts off after just the first few letters of her name so it seems pointless and unnecessary to do this.
