Do both spouses need to be present at ROC interview?

I see, I thought after AOS, you already get a 10-year green card. I didn't go through AOS. After marriage I got a CR1. We were married in the Philippines, and waited 1 year and 4 months for the petition to be granted. I guess that's the difference between filing K1 and petition for spouse.

Only a few K-1 cases get 10-year Green Card when USCIS takes so long to approve Form I-485. If on the date USCIS approves Form I-485 the marriage is less than 2 years old then they get 2-year GC; if instead the marriage is 2 years or more on Form I-485 approval date then it's a 10-year GC. See INA 216(h):

(1) The term "alien spouse" means an alien who obtains the status of an alien lawfully admitted for permanent residence (whether on a conditional basis or otherwise)-

(A) as an immediate relative (described in section 1151(b) of this title) as the spouse of a citizen of the United States,

by virtue of a marriage which was entered into less than 24 months before the date the alien obtains such status by virtue of such marriage, but does not include such an alien who only obtains such status as a result of section 1153(d) of this title.

(2) The term "alien son or daughter" means an alien who obtains the status of an alien lawfully admitted for permanent residence (whether on a conditional basis or otherwise) by virtue of being the son or daughter of an individual through a qualifying marriage.

(3) The term "qualifying marriage" means the marriage described to in paragraph (1).

(4) The term "petitioning spouse" means the spouse of a qualifying marriage, other than the alien.

 

If somehow the wrong card is issued then Form I-90 should be filed for freehttps://www.uscis.gov/i-90 "(D) My existing card has incorrect data because of DHS error."

I just want to update all and express my deepest appreciation especially to those who greatly contribute to this topic. You know who you are. Thank you and good luck to everyone who are still in the same endeavor. Below is my timeline, August 17 was our actual interview. 

 

August 24, 2021 Card Was Mailed To Me
August 20, 2021 We approved your Form I-751, Petition to Remove Conditions on Residence.
August 19, 2021 We ordered your new card.
July 12, 2021 We scheduled an interview for your Form I-751, Petition to Remove Conditions on Residence.
July 7, 2021 We are ready to schedule your Form I-751, Petition to Remove Conditions on Residence, for an interview.
June 23, 2021 We received your response for Form I-751, Petition to Remove Conditions on Residence.
April 14, 2021 We sent a request for initial evidence for your Form I-751, Petition to Remove Conditions on Residence.
November 13, 2020 The fingerprints relating to your Form I-751 Petition to Remove Conditions on Residence, were taken.
June 30, 2020 We received your Form I-751, Petition to Remove Conditions on Residence.

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

The interview is more of fact-finding, verifying the information and details of the evidences that we've submitted. First question was what was the RFE, what was written on it and described what you did, basically the officer asked what was in the letter. The officer would actually tell who needs to answer the question. My husband was asked what was my full maiden name. He forgot my second christian name. The officer is very patient, said it's okay if he doesn't know. Took him by surprise when my husband finally remembers it 5 minutes after and asked what he did to remember it. Other questions are past marriages (2nd for my husband, 1st for me), how did you two meet, what are your future plans, what is the relationship situation between in-laws, and more personal questions about your marriage.

 

Here are the evidences we have that I can remember:

- Joint leases - all leases/mortgages from the time the petitioner entered the US. we have no mortgage loans, both names are on the lease contract

- Driver's licenses - shows same po box address

- Electric bills - both names are on the bill with current lease physical address

- Phone bills - Under my husband's name, with me and my step-daughter's on the account. 

- Car insurance - shows both names and same current physical address on the card. Vehicle is under my husband and father-in-law's name.

- Health Insurance - I am the primary, my husband and step-daughter are beneficiaries

- Retirement plans - I am the primary, my husband is 100% beneficiary

- Life insurance - I am the holder, my husband and step-daughter are beneficiaries

- Gym membership and subscriptions i.e Netflix, Google Tv, Disney Plus

- Personal letters and cards for special occasions i.e. birthday, valentine's, anniversary

- Emails and text messages from step-daughter and in-laws

- lots and lots of photos with families and friends - on each photo, I wrote a small description and dates

- snap shot of facebook posts - if you can include the comments, much better

- 2 affidavit letter of support - 1 from our land lord and 1 from my friend -  not notarized, but they need to have their letter have the statements " I swear, under penalty of perjury, that the foregoing is true and correct to the best of my knowledge." - Fish and Hunt licenses - both shows po box address

- Step-daughter's school correspondences both addressed to me and my husband
