Do both spouses need to be present at ROC interview?

I am guessing you are an attorney or perhaps a very concerned citizen, but either way I am delighted to see VJ has people like you. i absolutely would. Worst case scenario, they say he is not needed, and do not let him in.

 

but if he IS needed, and hes NOT there, it could cause issues (or at least much more in time and travel expenses)

 

better safe than sorry.

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

I have seen several people saying recently that their interview letter did not state that the spouse has to attend. Yesterday, someone with that letter went for the interview but apparently was asked why the spouse was not in attendance. I won't chance it even if the letter doesn't state it. Better to bring your spouse and not be asked to have him or her in the interview room than to have no spouse there.

What was the RFE for? I need to file next January but I’m trying to learn from everyone’s experience!

Thank you for the heads up. I'm already convinced to bring my husband with me when I read the federal statutes. :)

Request for initial evidence. They will send you a notice of what evidences you need to submit and what to include in your response i.e. joint financial documents,  taxes filed jointly, mortgages/leases, insurance, birth certificate of children if applicable, and all others that will show your marriage is bona fide. You might not receive an RFE if you have sufficient overwhelming evidence with your initial ROC filing, although I think most of the time they still do. 

 

I filed mine by myself without an attorney. I only followed the directions and read entirely what is on the USCIS website. I have provided all of the evidences I could think of, but they still sent me an RFE. The RFE requested new evidences that I have not sent originally. I took lots of photos, ask affidavits from friends and new financial documents, insurance renewals, etc.

oh, so ROC is also needed after AOS. Wow! Keep it going... Good luck with your filing too. Will definitely let everyone know how it went. ;)

Yes it is. ROC is needed when you get a two-year conditional green card. I file next January jointly with hubby, but I’m a huge planner so that’s why I was asking you!
