tax returns - prepping for interview

I'm a Canadian and a beneficiary. My wife is a petitioner and she is an American citizen.

My wife filled out the I-864 as the primary sponsor and her brother is a household member who lives at the same address. I have a few questions that I would like to ask.

  1. I'm currently prepping for the CR1/IR1 visa interview. I printed out the recent years tax returns (pdf version) of the household member who completed the form I-864A,Contract between Sponsor and Household Member. He lost the physical tax return documents so he asked his accountant to resend the most recent 4 years tax returns. It came in a pdf version on the computer so it doesn't show the signatures. Would a Montreal consular officer accept that during the interview?
  2. My wife's brother filled out the form I-864A,Contract between Sponsor and Household Member, to combine the income with my wife to sponsor me. He's married and filed tax jointly with his wife for the year of 2019 and 2020. Does his wife also need to fill out the form I-864A? (His wife is not sponsoring me though and his wife isn't working also)

Best regards,

Thanks!

If Brother and wife file joint tax returns and his/their income qualifies without adding the petitioner's income, then Brother should be joint sponsor, and his wife is HIS household member.  In that case, the petitioner does not combine income with anybody.  She just completes her affidavit as petitioner.

Each sponsor, principal or joint, need a separate I-864, not I-864A.  IRS tax transcripts are easier to get (taxpayer can instantly download them from irs.gov) and are preferred by officers since they are directly from IRS and confirm income, taxes, etc.  The only time the full 1040 plus all supporting schedules and documentation are needed is for a sponsor who is self-employed.  Good luck!
