Hi Please has anyone immigrated with derivatives? I am FB1 ( unmarried daughter of a us citizen)and not married but have 5 children. Will I be asked to do DNA for my children? At the interview

there is no limit as to # of children

needed is permission from father of each (maybe court order that you have complete custody)

DNA  - your guess is as good as any 

They all have the same father. Only three were listed on the original petition but I added the rest of the two later on CAEC . But I just want to to know if I will be  asked  to do a DNA since the children are 5 now.

It’s possible you may have to. No one can tell you for certain. If they are your children you have nothing to worry about.

anyway you might be asked for dna if the consul does not find the birth certificates acceptable proof.

Yes the two were born after the petition was filed and they’re ages are 5 and 2

next question

does sponsor have enough income to support all of you plus family members already living with him

and since he can not add grandchildren to health care insurance,  can he afford it ?

even if you come and can work full time, day care,  withholding taxes and health care for you and your kids will take just about your pay check 

 

i live in one of the cheapest states and day care for 1 child here is $185 a week

@JeanneAdilmakes a good point. The sponsor income will need to be sufficient to cover all of you but also childcare is expensive. The 5 year old will probably have started public school by the time you get there (at least TK or K even if you come soon) but the little one could be expensive, is there a relative not working able to watch the toddler while you work?

1. My dad lives alone he actually filed for me and my siblings. We actually 3 and all of us have children the children in total are 7 plus us so we are all 10 in number. My dads income is 36,000 but we all have one joint sponsor my brother and his wife. My brother has two properties pls can it cater for the 10 of us ? My brother had 5 children in his house
 

2. Since  we all have different I-130 and  we all got different interview dates will it be judged according to the principal applicants and its derivatives? I mean my little sis who has only one child will she be granted the visa since my dad income can cater for her and her child or all us will be judged together?

please answer both questions above

1. That’s nowhere near enough income. Actually it is more than 10 people as your dad and anyone who lives with him must be added in. So at least  $72850 for that (11 including your dad) and add $5675 per extra person in the household. For your brother to use assets, the assets have to be worth 5x the difference between the actual income and required income, and be able to be liquidated for cash within a year without hardship to the owner. See the i864 instructions for more detail

 

2. Well you won’t all be interviewed together. Your dad’s income can cover a household of 4, so it will work for the sibling who has one child. Bear in mind these are minimum incomes and other factors matter example if none of the siblings work then there will be a question over future public charge (we’ve seen people from some countries denied for this and told to come back when they can show a work history).

Thank you very much. So are you saying only my sibling with one child will be be granted the visa based on my dads income?
