I recently had a legal consult with an immigration lawyer he said since my girlfriend has a tourist visa she can come to the USA and then we can get engaged. He can file K1Visa petition and she can stay here until the tourist visa expires in 2 years and by then we will be married. Does that sound right?

Nope.  That is immigration fraud.

Your fiancé can certainly come and visit you temporarily in the US, not come and live here until the petition gets adjudicated. She has to come back to her country to wait for the process. Besides, six months is generally the maximum amount of time your fiancé can lawfully stay on her tourist visa. After 6 months, she is out of status and subject to deportation.

Nope.  This is, yet, another example of an attorney who is incompetent.

Please do share the name of this lawyer who gave you such disastrously incorrect advice.

I agree. People need to know to not use this attorney. Maybe even report him for providing fraudulent advice?

I was thinking that, too.  Both to USCIS and to his state bar.

I seriously doubt an Immigration Lawyer actually said this.

Sounds like it has been heavily corrupted.

Yes.  Someone's neighbor's uncle's postman saw it on the YouTubes.

I agree. We know immigration lawyers often don't seem to know what they're doing, but I can't imagine any would actually advise blatant immigration fraud.

I certainly hope you didn't hire this attorney if he advised this

Not all states recognize common law marriage

and if you think to try this,  think again

your instincts were to ask the question here,  so you must not have believed the lawyer

have her visit ,  apply the K1 ,  she returns home

or have her visit,  marry,  apply the CR1 and she returns  home

Wait it out and do it legally or look for a lot of problems trying to get her green card
