Timeline

Hello all,

hope everyone is doing ok.
There is a section on the instructions section which talks about having 2 people sign affidavits as proof of on-going marriage. It is listed as #5 in the instructions.

My question is - is this really necessary?

It seems to be a bit much to have two people make a letter, sign it and have that be sent in.
If anyone with any experience can chime in - if you didnt send it and what happened.
I would appreciate that much.

@MateR affidavits carry little weight. Theyre only somewhat useful if you do not have more substantial evidence available.

 

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.

I don’t know why people keep saying that is not necessary. Of course it’s optional, you send evidence that you have available. But my point is most people send evidence that is easy to present. For example lots of people recommend sending copies of both Drivers licenses, yes it is recommended, it is easy to get, but is not even mentioned in the instructions. Affidavits are definitely mentioned in the instructions, if they were weak evidence they wouldn’t even mention it. I always think the more the better. Send lots of evidence in a clean and organized way to avoid a RFE.

@Ecaen87 - ditto - this is what we have always done and have seemed to fly through the process easier than some of the other stories here. We have *knock on wood* never had an RFE. we try to make it as complete as possible in an organized fashion where once the officer opens that file - it is right there in a row with what we presume they would want to see.

They are weak because anybody can write something for you. Nobody is going to knock on their door to ask them if they really know you. Plus, for ROC you are supposed to be able to produce more substantial evidence than for AOS, such as joint bank statements, 401s/IRAs accounts, health and car insurance, mortgages, child's BC, etc etc.

July 18, 2023 approval

July 20, 2023 Card in hand

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

No, they are not necessary and they are actually considered weak evidence. Anybody can write an affidavit for you. Instead, focus on QUALITY of evidence, such as leases, joint bank statements, utility bills, mortgages, insurance, etc.

Starting Sept. 4, 2021, USCIS is extending the time that receipt notices can be used to show evidence of status from 18 months to 24 months for petitioners who properly file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status.
