I’m a US citizen who has been waiting for any response from USCIS about my I-130 petition for my wife. It’s been a year and a half and when I put my request for information because it’s outside processing times they lied and said they sent a response. I called them later and they said it’s been sent to a local field office. I’m wondering if anyone has had a similar experience with USCIS and if anyone has any experience suing USCIS. They received the case Feb. 5, 2020 and other than that there’s been no correspondence or movement on the case at all

It is unusual but not unheard of for an I-130 case to be sent to a local field office.  I’ve read about:

 

* USCIS wants biometrics on the petitioner if it questions the identity of the petitioner. 
 

* USCIS wants to interview the petitioner 

 

But Ocean’s Razor suggests that you spoke to yet another clueless tier 1 officer.  Make sure you have a tier 2 officer to get a more reliable story.

No I filled it out correctly, the latest status is the same as it’s always been. Case was received and a receipt notice was sent February 5, 2020

I saw on one of your other threads (it really helps if you keep everything to one thread by the way so all info is there) that you were at Potomac service center. You are only just outside normal processing time by a couple of weeks there (5 Feb vs 22 Feb 2020]. Have you submitted an online query about outside of normal processing time since that happened, which was probably quite recently? The receipt notice status will be there until case approved.

Ok, yes I submitted the inquiry. And there was no response, just a claim that a response was sent on July 1, that’s a blatant lie. So when I called they seemed confused, last three digits of service request is tsc which means Texas service center but they said my case is at a local field office.

You checked your junk folder? I’d call again if I were you and if they again say your case is at a local field office, ask why. If they don’t know ask for a tier 2, though I have heard that tier 2 is currently operating on a callback system that can take up to 21 days.

I'm also a Feb petitioner. My case has been sent to the Seattle local office and I'm in the same boat. I was thinking of writing a physical letter to that office to see if it would make a difference. Not really sure what to do. I'd anyone else has any ideas please let us know

Yes, tier 2 is working on a call back system and taking 21 days. Based on my latest experience, they closed my inquiry without actually calling me... lol.

 

I did speak to a tier 1 who said they are expecting to open the field offices to the public soon (maybe August), which should help speed up the inquiry process.
