Hello all,

I am close to submitting my I-130 petition for my wife, and I am filling my petition online. I have kind of a serious question. One of the questions on the I-130 online states (At which U.S. Embassy or Consulate location will the beneficiary apply for an immigrant visa?). My wife is a Togolese national, but has been living in France now for 5 years as a student, which enabled her to gain a French resident card called (Carte de sejour). She is able to renew her (carte de sejour) each year because she is a student in France. My question is should I choose the the U.S. embassy in Togo, or the one in France as the place where she will be able to apply for the immigrant visa once the I-130 is approved. Is it possible to do the interview in a country where you reside which is not your home country?

Timeline

As a legal permanent resident she can interview in that country

Question is:   will she be living In France 18 months from now?

or does she have to return to her home country at end of her student studies ?

if she does have to return to Togo,  she needs a criminal report from France before leaving to satisfy the NVC process and interview

Yes, she plans to renew her (carte de sejour) again, which is set expire in Febuary of next year. So yes, she will be staying in France.

She can choose to interview either in her home country Togo or France (if she is still resident there when the time comes to interview). It may also be worth following which of the two US embassies is processing spousal visas faster / closer to approaching normal pre-Covid processing rates.

NVC will assign the embassy/consulate in the country the beneficiary is currently living at, so it will be France regardless of what you put there.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Most likely France. Just note that she will need a police certificate from both countries.

29 Apr 2020: I-130 filed online

11 Dec 2020: I-130 approved

 

NVC

17 Dec 2020: NVC Received

25 Jan 2021: Paid AOS and IV fees

14 Apr 2021: Submitted I-864, I-864A and DS-260

14 Apr 2021: Expedite request

04 May 2021: Expedite approved, case sent to Consulate in Naples, Italy

 

US Consulate Naples, Italy

04 May 2021: Consulate received

18 May 2021: Requested expedited interview

20 May 2021: Expedited interview approved and scheduled for 8th June

07 Jun 2021: Medical at Istituto Varelli (Naples, Italy) - Very friendly staff, spoke English

08 Jun 2021: Interview - APPROVED

09 Jun 2021: Picked up passport with Visa in person from Consulate 

 

USA

17 June 2021: Entered New York (JFK) as Point of Entry

17 June 2021: Landed in Arizona and reunited with my wife :) 

28 June 2021: Received Social Security Number

10 July 2021: Form I-551 (Green Card) marked as in production

15 July 2021: Form I-551 (Green Card) received in the post
